HomeMy WebLinkAbout022381 ORD - 10/17/1995AN ORDINANCE AMENDING THE CORPUS CHRISTI ZONING ORDINANCE ARTICLE 28, "PUD" PLANNED UNIT DEVELOPMENT, SECTION 28-5, PROCEDURE AND ARTICLE 33, PERMITS, PLATS, AND FILING FEES, SECTION 33-1, PERMITS AND SECTION 33-3, FILING FEES, BY INCREASING CONDITIONAL SIGN PERMIT FEES, PUD PROCESSING FEES, AND FILING FEES FOR ZONING DISTRICT CLASSIFICATION CHANGES; AND PROVIDING FOR SEVERANCE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning an amendment to the Zoning Ordinance of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, August 9, 1995, during a meeting of the Planning Commission and on Tuesday, October 10, 1995, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. SECTION 1. That the Zoning Ordinance, Article 28, "PUD" Planned Unit Development, Section 28-5, Procedure, Subparagraph (C) is hereby amended as follows: (C) Plan of Development. To utilize the provisions of this article, ten (10) copies of the proposed plan of development accompanied by processing fees, as prescribed in the following schedule, shall be submitted to the Department of Planning. SCHEDULE OF PROCESSING FEES Up to 5 acres $263.00 5 - 10 acres $420.00 11 - 20 acres $683.00 Over 20 acres $1 050.00 Up to 5 acres $250.00 5 10 aeres $400.00 11 20 aeres $650.00 Over 20 acres $1,000.00 95NH2830.201 / 9-20-95 Zoning Fees • 2 The processing fees shall be in addition to all other fees and are for the purpose of defraying the greater costs of examining and formulating recommendations on the plan of development. The plan of development shall include the following drawing or drawings prepared at the scale of 1" - 50': (1) A dimensioned layout of any buildings, open spaces, recreational areas and other elements basic to the proposed use, including the amounts of the proposed uses in square feet or acres, with identifiable matching designation of the total number of units and/or habitable improvements to be placed within each delineated area or space. (2) Locations, amounts and types of non-residential uses within the area proposed to be developed. In the event that these non-residential uses are of the type intended to serve only the residents of the PUD, documentation shall be attached as specified in Section 28-4(B) of this article. (3) 95NH2830.201 / 9-20-95 Zoning Fees (a) The size and location of all vehicular and pedestrian access points to the PUD. (b) The number, dimensions overall, and location of all parking spaces. (c) The pattern, estimated traffic volumes, width, and type of paving proposed for all vehicular movement areas. (d) The pattern, width and type of paving for all sidewalks and other pedestrian movement areas. (e) All proposed screening and/or lighting of parking and other areas, shall also be illustrated. The plan of development shall also include at an appropriate scale or in some appropriate form as determined within the guidelines of this ordinance and the Platting Ordinance by the Director of Planning as to (a) hereof, and by the City Attorney as to (b) hereof, the following: (a) A plot plan showing contours and elevations. (b) The required legal documents as specified in Section 28-4 (H) of this article. Included as part of these documents shall be proof of the financial responsibility of the established entity to maintain the common area as required in Section 28-4(H) of this article. The required legal documents will include deed restrictions and common and part -wall agreements. (c) In the event that the PUD is to be developed in stages or phases a staging plan with estimated times of development is to be included as part of the plan of development. 3 SECTION 2. That the Zoning Ordinance, Article 33, Permits, Plats, And Filing Fees, Section 33-1, Permits, Subparagraph 33-1.05 is hereby amended as follows: 33-1.05 Any person, firm, or corporation, upon filing a request with the Department of Planning for a conditional permit for a sign as required of Subsection 33-1.01, shall be required to pay in advance the sum of Two Hundred Forty Seven ($247.001 e An application for a conditional permit initiated by the City Council, the Planning Commission, or any City Staff member acting in his capacity as City Staff member shall be without fee. SECTION 3. That the Zoning Ordinance, Article 33, Permits, Plats, And Filing Fees, Section 33-3, Filing Fees, Subparagraph 33-3.01 is hereby amended as follows: 33-3.01 Any person, firm, or corporation upon filing with the Department of Planning and Urban Development of any application for a zoning district classification change, necessitating the sending of notices and publication of notices in the newspaper shall be required to pay in advance the following sum: Zoning Filing Fees Acres Proposed Fees 0.00 - 0.249 0.25 - 0.99 1.00 - 4.99 5.00 - 9.99 10.00 - 14.99 15.00 - 19.99 20.00 - 24.99 25.00+ Less than .25 acre .25 to .99 acrc 1 to 9.99 acrcs 10 to 19.99 acrcs 201 acrcs $516.00 $563.00 $786.00 $1.116.00 $1.254.00 $1.428.00 $1.509.00 $1.509.00 + $50 per acre over 25 $ 250.00 $ 350.00 $ 525.00 $ 965.00 $1,300.00 In the event the Planning Commission does not favorably recommend the zoning district change and the applicant withdraws his application before 95NH2830.201 / 9-20-95 Zoning Fees 4 it is forwarded to the City Council for public hearing and determination as provided in Article 30 of this ordinance, then 35 percent of the application fee shall be refunded upon written request by the applicant. An application for a zoning district classification change initiated by the City Council, the Planning Commission, and City staff member (acting in his capacity as City staff member) of any other Board or Agency of the City of Corpus Christi shall be without fee. 33-3.02 Fence Exceptions. Any person, firm, or corporation, upon filing a request with the Department of Planning for an exception to the requirement of Subsection 27-3.01.06 of this ordinance, necessitating the sending of notices and publication of notices in the newspaper, shall be required to pay in advance Three Hundred Thirty Six ($336.00) Thrcc Ilundred Twcnty Della. In the event the Planning Commission does not favorably recommend the fence exception and the applicant withdraws his request before it is forwarded to the City Council for public hearing and determination as provided in Article 30 of this ordinance, then 35 percent of the application fee shall be refunded upon written request by the applicant. 33 3.03 Prczoning filing fees.
