HomeMy WebLinkAbout022417 ORD - 11/21/1995AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF THREE STREET RIGHTS- OF-WAY OUT OF BRENNAN ADDITION: A 5,471.14 -SQUARE FOOT PORTION OF JACK STREET RIGHT-OF-WAY FROM 19TH STREET TO DOSS STREET, APPROXIMATELY 195 FEET IN LENGTH; A 12,806.64 - SQUARE FOOT PORTION OF DOSS STREET RIGHT-OF-WAY, APPROXIMATELY 213 FEET IN LENGTH, EXTENDING FROM LIPAN STREET TO A POINT APPROXIMATELY 213.45 FEET SOUTH TO THE NORTH BOUNDARY LINE OF THE PRIOUR TRACT; AND A 8,363.52 - SQUARE FOOT PORTION OF ROBERT STREET RIGHT-OF-WAY, APPROXIMATELY 279 FEET IN LENGTH, EXTENDING FROM LIPAN STREET TO A POINT APPROXIMATELY 279.02 FEET SOUTH TO THE NORTH BOUNDARY LINE OF THE PRIOUR TRACT; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE. WHEREAS, there exists a 5,471.14 -square foot portion of Jack Street right-of-way from 19th Street to Doss Street approximately 195 feet in length, shown by plat recorded in Volume 8, Page 33, of the Map Records of Nueces County, Texas; WHEREAS, there exists a 12,806.64 -square foot portion of Doss Street right-of-way, approximately 213 feet in length, extending from Lipan Street to a point approximately 213.45 feet south to the north boundary line of the Priour Tract, shown by plat recorded in Volume 8, Page 33, of the Map Records of Nueces County, Texas; WHEREAS, there exists a 8,363.52 -square foot portion of Robert Street right-of-way, approximately 279 feet in length, extending from Lipan Street to a point approximately 279.02 feet south to the north boundary line of the Priour Tract, shown by plat recorded in Volume 8, Page 33, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said rights-of-way, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a) a 5,471.14 -square foot portion of Jack Street right-of-way from 19th Street to Doss Street, approximately 195 feet in length; 95ag5000.804.vr November8, 1995 ` Mail LMEU b) a 12,806.64 -square foot portion of Doss Street right-of-way, approximately 213 feet in length, extending from Lipan Street to a point approximately 213.45 feet south to the north boundary line of the Priour Tract; and c) a 8,363.52 -square foot portion of Robert Street right-of-way, approximately 279 feet in length, extending from Lipan Street to a point approximately 279.02 feet south to the north boundary line of the Priour Tract all as shown by plat recorded in Volume 8, Page 33, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner plat a drainage easement for an existing concrete -lined drainage ditch across Jack Street. 2) That Owner plat a ten -foot utility easement along the west side of Robert Street for an existing 7.2/12KV CPL power line. 3) That Owner replat the property within 180 days at its expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.804.vr November 8, 1995 R T r That the foregoing ordinance was C4 day of 1.)0 vCbwlau- Mary Rhodes Dr. Jack Best Betty Black Melody Cooper Tony Heldenfels read for the first time and passed to its second reading on this the , 19 q by the following vote: Betty Jean Longoria John Longoria Edward A.
