HomeMy WebLinkAbout022425 ORD - 11/21/19951 ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI TO CREATE A MUNICIPAL COURT BUILDING SECURITY FUND; REQUIRING DEFENDANTS CONVICTED OF MISDEMEANOR OFFENSES IN MUNICIPAL COURT TO PAY A $3.00 SECURITY FEE AS A COST OF COURT; PROVIDING FOR SEVERABILITY; SPECIFYING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. WHEREAS, effective September 1, 1995, Texas law permits a municipality to create a municipal court building security fund and to require a defendant convicted for a misdemeanor offense in a municipal court to pay a $3.00 security fee as a cost of court, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The Code of Ordinances, City of Corpus Christi is amended by adding Section 29-48 as follows: Court. SEC. 29-48 Municipal Court Building Security Fund and Security Fee as Cost of a) There is created a municipal court building security fund. A defendant convicted for a misdemeanor offense in municipal court shall pay a $3.00 security fee as a cost of court. The fee shall be assessed for all misdemeanor convictions including those processed by mail. b) For purposes of this section 29-48, a person is considered convicted if: 1) a sentence is imposed on the person; 2) the person receives community supervision, including deferred adjudication; or 3) the court defers final disposition of the person's case. c) The Municipal Court Administrator shall collect this cost of court and pay it to the city treasurer. The security fee so collected shall be deposited in a fund to be known as the Municipal Court Building Security Fund. d) The Municipal Court Building Security Fund may be used only to finance the MS5000006.bek November 3, 1995(120pm) _) � r + ?...-s25 MytROE ILMEP 2 following items when used for the purpose of providing security services for buildings housing a municipal court: 1) the purchase or repair of X-ray machines and conveying systems; 2) hand held metal detectors; 3) walk-through metal detectors; 4) identification cards and systems; 5) electronic locking and surveillance equipment; 6) bailiffs or contract security personnel during times when they are providing appropriate security services; 7) signage; 8) confiscated weapon inventory and tracking systems; or 9) locks, chains, or other security hardware. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. This ordinance shall take effect on December 1, 1995. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance.
