HomeMy WebLinkAbout022441 ORD - 12/19/1995AN ORDINANCE ANNEXING ADJACENT AND CONTIGUOUS TERRITORY CONTAINING NINE TRACTS OF LAND TO THE CITY OF CORPUS CHRISTI, TEXAS; DECLARING SUCH TERRITORY AN INTEGRAL PART OF THE CITY OF CORPUS CHRISTI, TEXAS; FULLY DESCRIBING THE ANNEXED TERRITORY; ADOPTING A SERVICE PLAN FOR THE ANNEXED TERRITORY; FIXING NEW BOUNDARIES FOR THE CITY OF CORPUS CHRISTI, TEXAS; DECLARING INHABITANTS AND PROPERTY OWNERS ENTITLED TO ALL THE SAME RIGHTS, PRIVILEGES AND BURDENS OF OTHER CITIZENS OF THE CITY; DECLARING THE ANNEXED TERRITORY SUBJECT TO THE CITY CHARTER AND THE ORDINANCES, RESOLUTIONS, MOTIONS, LAWS, RULES AND REGULATIONS OF THE CITY OF CORPUS CHRISTI; AND PROVIDING FOR SEVERANCE. WHEREAS, the City of Corpus Christi desires to annex said territory to the City of Corpus Christi; WHEREAS, on November 14, 1995 public hearings were held in Tract A6 and Tract A7 of the area proposed for annexation, following publication of notice of said hearings in a newspaper of general circulation in the City of Corpus Christi, for the consideration of annexation proceedings and the service plan for the defined lands and territory at which all persons interested in the annexation were given the opportunity to be heard; WHEREAS, a service plan for the area proposed to be annexed was made available for public inspection and explained at public hearings held in Tract A6 and Tract A7 of the area proposed for annexation on November 14, 1995; WHEREAS, on November 15, 1995 and November 21, 1995 public hearings were held, following publication of notice of said hearings in a newspaper of general circulation in the City of Corpus Christi, for the consideration of annexation proceedings and the service plan for the defined lands and territory at which all persons interested in the annexation were given the opportunity to be heard; WHEREAS, a service plan for the area proposed to be annexed was made available for public inspection and explained at public hearings on November 15, 1995 and November 21, 1995; WHEREAS, it has been determined by the City Council that the territory now proposed to be annexed lies wholly within the extraterritorial jurisdiction of the City of Corpus Christi; WHEREAS, it has been determined by the City Council that the territory now proposed to be annexed abuts and is contiguous and adjacent to the City of Corpus Christi; WHEREAS, it has been determined by the City Council that the territory now proposed to 95NH2870.217 12-04-95 7 0 2.-i 1 MICROFILMED 2 be annexed constitutes lands and territories subject to annexation as provided by the City Charter of the City of Corpus Christi and the laws of the State of Texas; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the lands and territory hereinafter described. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an area, Tract A5, Part 1, consisting of a 35.07 acre tract, more or less, out of a 400 acre tract of the Mariano L. DeHerrera Grant, Abstract 606, said 400 acre tract conveyed by Bess L. Hurt, et vir, to Nina G. Stewart, widow, by Deed dated June 23, 1944, and recorded in Volume 300, Page 153, Deed Records of Nueces County, Texas , is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit A" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 2. That an area, Tract A5, Part 2, a 64.60 acre tract, more or less, out of Annex No. 1 to the Nueces River Irrigation Park, a map of which is recorded in Volume A, Page 55, Map Records, Nueces County, Texas, said 64.60 acre tract is out of a 77.5 acre tract described by deed to Audry Smith Bagnall and recorded in Volume 250, Page 317, Deed Records, Nueces County, Texas, is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit B" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 3. That an area, Tract A6, consisting of a 488 acre tract, more or less, bounded on the north by the present City limit line, as it meanders along the south side of F.M. 624, bounded on the east by U.S. Highway 77, bounded on the south by County Road 52, the north boundary of Valley View Subdivision and the north boundary line of Rio Lado Acres Subdivision, and bounded on the west by the northerly extension of the west line of Rio Lado Acres Subdivision the same line being approximately 2,800 feet west of and parallel with F.M. 1889, is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit C" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 4. That an area, Tract A7, consisting of a 715 acre tract, more or less, bounded on the north by the present city limit line, the southerly low water line of the Nueces River, bounded on the east by a segment of existing River Lane, the present city limit line, the southwesterly low water line of the Nueces River and by existing Lindgreen River Road, bounded on the south by the present city limit line as it meanders westerly through the San Carlos Addition Area and bounded on the east by the present city limit line as it meanders northerly on the west side of Interstate Highway 37, is hereby annexed to and brought within the corporate limits and made an integral part 95NH2870.217 12-04-95 3 of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit D" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 5. That an area, Tract A9, consisting of a 362 acre tract, more or less, bounded on the north by F.M. 624, bounded on the east by the east line of a 68.788 acre tract, now or formerly owned by Katherine Lontos et al, bounded on the south by the south line of said 68.788 acre tract, by the south line of a 120.16 acre tract now or formerly owned by Earl V. Wright, et al and by the south line of a 52.092 acre tract now or formerly owned by Glen Humphrey, Jr. and bounded on the west by the east line of a 41.906 acre tract now or formerly owned by Robert Litchfield, is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit E" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 6. That an area, Tract A10, consisting of 415 acres more or less, bounded on the north by the present city limit line, bounded on the east by the Union Pacific Railroad (formerly Missouri Pacific Railroad) right-of-way, bounded on the south by a line 1,570 feet north of and parallel with County Road 48, bounded on the west by U.S. Highway 77, generally located southeast of the Five Points intersection, is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit F" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 7. That an area, Tract Al 1, consisting of 0.0018 of an acre, more or less, owned by the Koch Refinery Co., located west of and adjacent to the present city limit line, between Oak Park Avenue and Nueces Bay Boulevard, approximately 700 feet south of the Union Pacific Railroad and approximately 300 feet west of Nueces Bay Boulevard, out of Southwestern Tract 2 as recorded in Volume 28, Page 1 of the Map Records of Nueces County, Texas is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory being described by metes and bounds in "Exhibit G" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 8. That an area, Tract Al2, consisting of a 13.602 acre tract, more or less, owned by the Koch Refinery Co., located west of and adjacent to the present city limit line, south of the Corpus Christi Ship Channel and approximately 700 feet west of Nueces Bay Boulevard, consisting of a 9.374 acre tract, more or less, out of a 14.48 acre tract as recorded in Volume 232, Page 284, Nueces County, Texas Deed Records, a 1.824 acre tract, more or less, out of Southwestern Tract 3 as recorded in Volume 28, Page 1, Nueces County, Texas, Map Records, a 1.664 acre tract, more or less, out of a 3.28 acre tract as recorded in Volume 1063, Page 551, Nueces County, Texas, Deed Records, and a 0.74 acre tract, more or less, out of the Union Pacific Railroad right-of-way, located between said 1.824 acre tract and said 1.664 acre tract is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi, said lands and territory 95NH2870.217 12-04-95 7 4 being described by metes and bounds in "Exhibit H" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 9. That an area, Tract A13, consisting of a 102.28 acre tract, more or less, owned by the Amerada Hess Corporation , located northwest of and adjacent to the present city limit line along Poth Lane, between Country Club Place Addition and the Union Pacific Railroad right-of-way, is hereby annexed to and brought within the corporate limits and made an integral part of the City of Corpus Christi effective January 1, 1996, said lands and territory being described by metes and bounds in "Exhibit I" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. SECTION 10. That there is hereby approved as part of this annexation ordinance a service plan, such service plan being described in "Exhibit J" which is attached hereto and by this reference made a part hereof for all purposes as though fully set forth herein. The service plan provides for the same number of services and levels of service for the annexed area to the same extent that such services are in existence in the area annexed immediately preceding the date of annexation or that are otherwise available in other parts of the city with land uses and population densities similar to those contemplated or projected in the area annexed. SECTION 11. That the owners and inhabitants of the tracts or parcels of land herein annexed shall hereafter be entitled to all the rights, privileges and burdens of other citizens and property owners of the City of Corpus Christi and shall be subject to and bound by the City Charter of the City of Corpus Christi, and the ordinances, resolutions, motions, laws, rules and regulations of the City of Corpus Christi to all intents and purposes as the present City of Corpus Christi is so subject. SECTION 12. That the official map and boundaries of the City, heretofore adopted and amended, be and is hereby amended so as to include the territory described above as part of the City of Corpus Christi, Texas. SECTION 13. That the City Manager or his designee is hereby directed and authorized to perform or cause to be performed all acts necessary to correct the official map of the City to add the territory hereby annexed as required by law. SECTION 14. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of the ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 95NH2870.217 12-04-95 5 That the foregoing ordinance was read for the first time and passed to its second reading on this the 12, day of 1%QCC1v„ r , 19 5 , by the following vote: Mary Rhodes Dr. Jack Best Betty Black Melody Cooper Tony Heldenfels Betty Jean Longoria John Longoria Edward A. Fire Protection And Ambulance Service The City of Corpus Christi, Texas, and its Fire Department will provide fire protection and ambulance service to the newly annexed tract at the same level of service now being provided to other areas of the City of Corpus Christi, Texas, with similar topography, land use and population within the City. Further, the City of Corpus Christi Fire Department and Ambulance Service will respond to all dispatched calls and requests for service or assistance within the newly annexed area. 3. Solid Waste Collection The City of Corpus Christi provides solid waste services to residential customers. Commercial customers may contract with the City or commercial collectors. Upon annexation the City will provide solid waste services to the area annexed within 60 days. 4. Maintenance Of Water And Waste Water Facilities Any and all water or waste water facilities owned or maintained by the City of Corpus Christi, Texas, at the time of the proposed annexation shall continue to be maintained by the City of Corpus Christi, Texas. Any and all water or waste water facilities which may be acquired subsequent to the annexation of the proposed area shall be maintained by the 95N1-12870.217 12-04-95 EXHIBIT J 30 City of Corpus Christi, Texas, to the extent of its ownership. The now existing water line mains at their existing locations shall be available for point of use extension based upon the current City's standard water extension policies now existing or as may be amended. Individual septic systems may be acceptable if City and County standards are met. 5. Maintenance Of Roads And Streets Any and all roads, streets or alleyways which are dedicated to the City of Corpus Christi, Texas, or which are owned by the City of Corpus Christi, Texas, shall be maintained to the same degree and extent that other roads, streets and alleyways are maintained in areas with similar topography, land use and population density. Any and all lighting of roads, streets and alleyways which may be positioned in a right-of-way, roadway or utility company easement shall be maintained by the applicable utility company servicing the City of Corpus Christi, Texas, pursuant to the rules, regulations and fees of such utility. Roads and streets under the responsibility of the County, will be maintained by the City upon dedication by the County to the City and City's acceptance of the rights-of-way. 6. Maintenance of Parks, Playgrounds and Swimming Pools Any park that may be under the responsibility of the County will be maintained by the City only upon dedication of the park by the County to the City and City's acceptance of said park. In the event any such parks, playgrounds or swimming pools do exist, and such parks, playgrounds or public swimming pools are accepted as City owned public facilities by the City of Corpus Christi, Texas, they will be maintained to the same extent and degree that parks, playgrounds and swimming pools and other similar areas of the City of Corpus Christi, Texas are maintained. 7. Maintenance Of Any Publicly Owned Facility, Building Or Municipal Service The City Council of the City of Corpus Christi, Texas, is not aware of the existence of any publicly owned facility, building or other municipal service now located in the area proposed for annexation. In the event any such publicly owned facility, building or municipal service does exist, is a public facility dedicated to the City of Corpus Christi, such facilities, buildings or municipal services are accepted by the City of Corpus Christi and will be maintained to the same extent and degree that publicly owned facilities, buildings or municipal services of the City of Corpus Christi, Texas are maintained. CONSTRUCTION OF ANY CAPITAL IMPROVEMENTS TO BEGIN WITHIN 21/4 YEARS 1. Police Protection And Fire Protection The City Council of the City of Corpus Christi, Texas, finds and determines it to be unnecessary to acquire or construct any capital improvement within 21/2 years of the 95NH2870.217 12-04-95 EXHIBIT J 31 effective date of the annexation of a particular annexed area for the purposes of providing fire protection. The City Council finds and determines that it has at the present time adequate facilities to provide the same type, kind and level of protection and service which is presently being administered to other areas already incorporated in the City of Corpus Christi, Texas, with the same or similar topography, land use and population density. 2. Water And Waste Water Facilities For the next 21/2 years the City Council of the City of Corpus Christi, Texas, finds and determines that water service or City water mains and wastewater collection lines exist for points of connection for serviceable extensions to provide service within the area to be annexed pursuant to the City's standard service extension policies now in existence or as may be amended by the City Council. 3. Roads And Streets Lighting Within 21/2 years from the date of the annexation of the proposed area, the City of Corpus Christi, Texas, with a cooperative effort of the City's designated electric utility franchise company, will undertake to provide the same degree of road and street lighting as is provided in areas of similar topography, land use and population density within the present corporate limits of the City of Corpus Christi, Texas. Maintenance of lighting for properly dedicated roads and streets will be consistent with the maintenance provided by the City to other roads and streets in areas of similar topography, land use and sub -development of the annexed property. New development will be required pursuant to the ordinances of the City of Corpus Christi, Texas, to provide internal and peripheral streets and to construct those streets in accordance with the specifications required by the City of Corpus Christi, Texas, for a properly dedicated street. 4. Provision Of Parks, Playgrounds, And Swimming Pools, And Any Other Publicly Owned Facility, Building Or Service To the extent that it becomes necessary because of development demands and population growth, the City Council of the City of Corpus Christi, Texas, will undertake to provide any such facility which it deems necessary to adequately provide for the health and safety of the citizens of the newly incorporated area based upon the standard considerations of comparable service levels provided properties within the City with similar topography, land use and population density. SPECIFIC FINDINGS The City Council of the City of Corpus Christi, Texas, finds and determines that this proposed Service Plan will not provide any fewer services, and it will not provide a lower level of service in the area proposed to be annexed than were in existence in the proposed area at the time 95NH2870.217 12-04-95 EXHIBIT J 32 immediately preceding the annexation process. Furthermore, the City Council of the City of Corpus Christi, Texas, finds and determines the rural nature of the area is characteristically different from other more highly developed areas within the corporate limits of the City of Corpus Christi, Texas. Consequently, because of the differing characteristics of topography, land utilization and population density, the service levels which may ultimately be provided in the newly annexed area may differ somewhat from services provided other areas of the City of Corpus Christi, Texas.
