HomeMy WebLinkAbout022449 ORD - 12/19/1995AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY CITY OF CORPUS CHRISTI, BY CHANGING THE ZONING MAP IN REFERENCE TO WEBB TRACT, TRACTS 6, 7, 8, 9, 10, 21 AND 22 BY ZONING OF NEWLY ANNEXED AREA TO "B-3" BUSINESS DISTRICT ON TRACT A13.1 AND "1-2" LIGHT INDUSTRIAL DISTRICT ON TRACT A13.2; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, November 15, 1995, during a meeting of the Planning Commission and on Tuesday, December 19, 1995, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Webb Tract, Tract 6, 7, 8, 9, 10, 21 and 22, located along the west side of Poth Lane, north of Interstate Highway 37 and along the south line of the Union Pacific Railroad, be zoned a "B-3" Business District on Tract A13.1 and "1-2" Light Industrial District on Tract A13.2, metes and bounds attached as Exhibit A. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. `��� 95nh2830.397/c1195-10 r� ,� (� �`�O``t December 8. 1995 0G G.. 4 49 M1C 2 SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall t e effect upon first reading as an emergency measure this the /.9 day of ��j2. / , 1995. Martin Dr. David McNichols 95nh2830.397/c1195-10 December 8, 1995 rt r 92:4,-9 4 METES AND BOUNDS Case No. C1195 -10A TRACT A13.1 A tract containing 102.28 acres, more or less, owned by the Amerada Hess Corporation , located northwest of and adjacent to the present city limit line along Poth Lane, between Country Club Place Addition and the Union Pacific Railroad, and more particularly described by General metes and bounds as follows; BEGINNING at a point on the west right-of-way line of 40 foot wide road, known as Poth Lane, at it's intersection with the north boundary line of Country Club Place Addition, a map of which is recorded in Volume 4, Page 3, of the Map Records of Nueces County, Texas, for the southeast comer of this tract, same point being the southeast corner of that certain 22.806 acre tract described in deed recorded in Volume 2211, Page 686, of the Deed Records of Nueces County, Texas; THENCE in the northwesterly direction, with the common boundary line of said Country Club Place Addition and 22.806 acre tract, to a point, for the southwest corner of said 22.806 acre tract and the southwest corner of this tract; THENCE in a northeasterly direction with the west line of said 22.806 acre tract, pass the south and north right-of-way lines, respectively of what is known as Tribble Lane and continuing with the west line of an 11.17 acre tract of land described in Volume 2211, Page 683, of the Deed Records of Nueces County, Texas, to a point of the south right-of-way line of the Union Pacific Railroad, for the northwest comer of this tract; THENCE with said south right-of-way line of Union Pacific Railroad, along a curve to the left, in a northeasterly direction, to a point, for a corner of this tract, same point being the northwest comer of a 7.0 acre tract, more or less, now or formerly owned by the Amerada Hess Corporation, for the northernmost comer of this tract; THENCE in a southeasterly direction, with the north boundary line of said 7.0 acre tract, to a point on aforementioned west right-of-way line of Poth Lane, for the northeast corner of said 7.0 acre tract and the northeast corner of this tract; THENCE in a southwesterly direction, with said west right-of-way line of Poth Lane, the present city limit line, to its intersection with the north boundary line of said Country Club Place Addition, for the POINT OF BEGINNING.
