AUTHORIZING THE CITY MANAGER TO EXECUTE A
MULTIPLE USE AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION TO PERMIT THE
CONSTRUCTION, MAINTENANCE AND OPERATION OF A
PUBLIC THERMAL ENERGY STORAGE (TES) TANK ON
THE HIGWAY RIGHT-OF-WAY, US 181, ADJACENT TO
THE HARBOR BRIDGE; AND DECLARING AN
EMERGENCY
WHEREAS, the City of Corpus Christi (the "City") has requested the State of Texas
("State") acting by and through the Texas Department of Transportation ("TxDOT") to permit the
construction, maintenance and operation of a public Thermal Energy Storage (TES) Tank on the
highway right of way, US 181, adjacent to the Harbor Bridge;
WHEREAS, the State of Texas has indicated its willingness to approve the establishment
of such facilities and other uses conditioned that the City will enter into agreements with the State
determining the respective responsibilities of the City and State;
WHEREAS, the City Council finds that it is in the public interest that the Thermal Energy
Storage Tank be constructed as contemplated under the Multiple Use Agreement; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is authorized to execute a Multiple Use Agreement
with the Texas Department of Transportation to permit the construction, maintenance and operation
of a public Thermal Energy Storage (TES) Tank on the highway right-of-way, US 181, adjacent to
the Harbor Bridge.
SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this ordinance is passed anshj11 take effect upon first reading as an

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
