HomeMy WebLinkAbout022462 ORD - 01/09/1996ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT TO PROVIDE CERTAIN PAVING AND LANDSCAPING SERVICES TO THE NUECES COUNTY APPRAISAL DISTRICT; AND DECLARING AN EMERGENCY WHEREAS, the City of Corpus Christi (the "City") has agreed to provide certain paving and landscaping services to the District (the "District") in exchange for its payment to the City of $25,000, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is authorized to execute an interlocal agreement to provide certain paving and landscaping services to the District at the District offices in Corpus Christi, Nueces County, Texas. A copy of this interlocal agreement is attached to this ordinance as Exhibit A. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of city affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as ro consideration and voting upon ordinances at two regular meetings so that is ordinance is passed and shall take effect upon first reading as an emergency measure this the day of 3031. Scanlon Assistant City Attorney MS5000.07I bak January 4, 1996 (I:45pm) 1 E; 2 ', leRenI ESE: INTERLOCAL AGREEMENT TO PROVIDE CERTAIN PAVING AND LANDSCAPING SERVICES This Interlocal Agreement to Provide Certain Paving and Construction Services (the "Agreement") is made between the City of Corpus Christi (the "City") and the Nueces County Tax Appraisal District (the "District"). The City and the District acknowledge and agree: 1. In exchange for the District's payment to the City of TWENTY-FIVE THOUSAND DOLLARS ($25.000.00), the City agrees to pave a certain parking area located behind the District's offices at Water and John Sartain Streets in Corpus Christi, Nueces County, Texas. Additionally, the City agrees to install certain landscaping improvements around or adjacent to the area to be paved. Collectively, these activities shall be referred to as the "Project". The Project area is designated in the site map attached to this Agreement as Exhibit A. 2. The City shall also prepare plans and specifications for the Project. The City shall be responsible for procuring the materials and labor necessary to complete the Project. 3. The District shall be responsible for procuring all permits and other documents, and paying any related fees, which are required to commence and complete Project construction in accordance with all applicable laws, rules, ordinances, and regulations. Payment of such fees by the District shall be in addition to the $25,000.00 payment described above. 4. The City agrees to review the construction plans and specifications with the District prior to the commencement of Project construction. Such construction will not commence until the District approves the plans and specification for the Project. 5. If the District and the City are unable to agree on the plans and specifications for the Project, then this Agreement may be terminated either by the City or the District upon written notice to the other party. If the Agreement is terminated for this reason, the City shall return to the. District any unexpended portion of the District's $25,000.00 payment. 6. The $25,000.00 payment shall not be held in an interest bearing account pending expenditure. 7. No work relating to the Project shall begin until both the City Council and the District have approved this Agreement. After such approval, work on the Project shall be completed within a reasonable time. 8. In accordance with Section 791.011(d)(3) of the Texas Government Code, the District certifies that payments made under this Agreement shall be made from current revenues available to it. 9. Prior to City Council consideration of this Agreement. the District shall deliver to the MS0921.010 mis(b4) Daaoba 22. 1995 (1.23pm) City its check in the amount of $25,000.00 and three (3) original. signed copies of this Agreement.
