HomeMy WebLinkAbout022491 ORD - 02/20/1996AN ORDINANCE CLOSING AND ABANDONING A 3,669.30 -SQUARE FOOT PORTION OF A 20 -FOOT WIDE ALLEY RIGHT-OF-WAY LOCATED ADJACENT TO LOT 1, BLOCK 49, THE PARK AT WOOD RIVER UNIT 8; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 3,669.30 -square foot portion of a 20 -foot wide alley right-of-way located adjacent to Lot 1, Block 49, The Park at Wood River Unit 8, shown by plat recorded in Volume 51, Pages 166 and 167, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said alley right-of-way, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 3,669.30 -square foot portion of a 20 -foot wide alley right-of-way located adjacent to Lot 1, Block 49, The Park at Wood River Unit 8, as shown by plat recorded in Volume 51, Pages 166 and 167, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner dedicate a 7.5 -foot wide by 20 -foot long utility easement on the south side of the far north property line of the lot, and a 7.5 -foot wide by 183.47 -foot long utility easement on the east side of the far west property line of Lot 1, Block 49, The Park at Wood River Unit 8. 2) That Owner pay the Fair Market Value of $2,875 for the alley closure of this portion of Lot 1, Block 49, The Park at Wood River Unit 8. 3) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 96ag5000.873.vr February 15, 1996 91 MICROFILMED SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is ��assed and shall take effect upon first reading as an emergency measure this the 213 day of 1th a , , 1996.
