HomeMy WebLinkAbout022514 ORD - 03/26/1996AN ORDINANCE AN ORDINANCE AUTHORIZING THE CITY ENGINEER TO GRANT SPECIAL USE PERMITS FOR DESIGNATED PORTIONS OF PUBLIC RIGHTS-OF-WAY TO PERSONS IN THE PROCESS OF OBTAINING NON- EXCLUSIVE FRANCHISES TO CONSTRUCT, MAINTAIN, AND OPERATE TELECOMMUNICATIONS FACILITIES; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi, Texas (hereinafter the "City") is in the process of authorizing one or more non-exclusive franchises for the purpose of constructing, maintaining and operating telecommunications facilities; and WHEREAS, upon approval of such franchises by the City Council on first reading the City is willing to authorize the City Engineer to grant temporary construction permits to any such prospective franchisee interested in commencing preliminary construction and testing operations in the public rights-of-way pending final approval of their franchises; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. The City Engineer is hereby authorized to grant temporary use permits for the public rights-of-way to any person or firm which is in the process of obtaining a franchise for telecommunications services for which the ordinance granting a franchise has been approved by the City Council on first reading. Such a temporary use permit shall allow the recipient to commence construction and testing of its telecommunications system pending the final approval and execution of a franchise ordinance. Nothing in such temporary use permit shall limit the right of the City Council to amend, alter or deny approval of any such franchise on second reading, and any such parties obtaining a special use permit under this Ordinance shall proceed at their own risk in any construction or testing activities thereunder. SECTION 2.
