AUTHORIZING THE ISSUANCE OF A CERTIFICATE OF
CONVENIENCE AND NECESSITY TO BRANSCUM TRANSPORTATION
SERVICE, INC. DBA YELLOW TAXI CAB COMPANY, JACK STERLING
BRANSCUM, PRESIDENT, FOR THE OPERATION OF A MAXIMUM OF
FIFTEEN TAXICABS WITHIN THE CITY OF CORPUS CHRISTI
THROUGH APRIL 9, 1996; SUBJECT TO COMPLIANCE WITH ALL
TERMS AND CONDITIONS ESTABLISHED IN CHAPTER 57, ARTICLE
II, TAXICABS, OF THE CODE OF ORDINANCES; AND CONTINUING
AND DEFERRING FURTHER PROCEEDINGS.
WHEREAS, Branscum Transportation Service, Inc. dba Yellow Cab Company (hereinafter
"Branscum") has made application to obtain a Certificate of Convenience and Necessity pursuant
to the requirements set out in Chapter 57 of the Code of Ordinances; and
WHEREAS, Section 57-33 of the Code of Ordinances requires that the City Manager or
his designee make a determination of whether the public convenience and necessity will justify
the granting of additional taxicab service; and
WHEREAS, a public hearing was held pursuant to the requirements of Section 57-35 of
the Code of Ordinances to allow holders of taxicab certificates or other citizens to file any
comments, complaints or protests regarding the issuance of a Certificate of Convenience and
Necessity to Branscum; and
WHEREAS, Bell Taxicab Company dba Yellow Cab Company of Corpus Christi filed for
Chapter 7 Bankruptcy on March 11, 1996; and
WHEREAS, use of the name "Yellow Cab Company" and associated telephone number
may belong to the bankrupt estate which has not been settled; and
WHEREAS, other persons have made application for certificates of convenience and
necessity, and proceedings on those applications are pending; and
WHEREAS, a temporary two-week Certificate of Convenience and Necessity will serve
the public convenience and necessity for taxicab service while bankruptcy proceedings are being
resolved and other applications for certificates are considered.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That a Certificate of Convenience and Necessity is issued to Branscum
Transportation Service, Inc. dba Yellow Cab Company, Jack Sterling Branscum, President, for
the operation of a maximum of fifteen taxicabs within the City of Corpus Christi commencing this
date and continuing through April 9, 1996, and on a weekly basis thereafter pending further action
by the City Council; subject to compliance with all terms and conditions established in Chapter
57, Article II, Taxicabs, of the Code of Ordinances.
SECTION 2. That further consideration and action by the City Council on Branscum's
application for a five-year certificate is continued and deferred until sufficient information is
presented to the City Council. The City Council may issue further orders on April 9, 1996, and
thereafter, extending the temporary certificate granted herein, and may issue a final determination
on Branscum's application whenever sufficient information becomes available, including
proceedings in the Bell Taxicabs bankruptcy and consideration of applications for certificates made
by other persons.
SECTION 3. That this resolution shall take effect immediately from and after its passage.
