HomeMy WebLinkAbout022557 RES - 04/30/1996A RESOLUTION SUPPORTING THE REQUEST BY THE LAVACA-NAVIDAD RIVER AUTHORITY FOR AN AMENDMENT OF THE LAKE TEXANA WATER RIGHTS PERMIT TO ALLOW THE TRANSFER AND USE OF LAKE TEXANA WATER IN THE CHOKE CANYON/LAKE CORPUS CHRISTI SERVICE AREA WHEREAS, the City of Corpus Christi is responsible for providing water supplies to communities and industries in a seven -county area in the Coastal Bend; and WHEREAS, the City of Corpus Christi, Texas has entered into a long-term water supply contract with the Lavaca-Navidad River Authority for the purchase of up to 41,840 acre- feet per year; and WHEREAS, the City of Corpus Christi is presently making annual payments to the Lavaca-Navidad River Authority for the purchase of this water; and WHEREAS, the Trans -Texas Water Program Study for the Corpus Christi service area, a long-range water supply planning study involving state agencies (Texas Water Development Board, Texas Natural Resource Conservation Commission, Texas Parks and Wildlife Department, and the Texas General Land Office), river authorities, municipalities and other interested parties, determined that the Lake Texana water supply was one of the most dependable, affordable and environmentally sound sources of additional water supply for the Corpus Christi area; and WHEREAS, the Lavaca-Navidad River Authority has made application to the Texas Natural Resource Conservation Commission for an amendment to the Lake Texana water right (Certificate of Adjudication No. 16-2095) for the purpose of allowing the use of Lake Texana water in the area now served by the Choke Canyon/Lake Corpus Christi reservoir system; and WHEREAS, since the filing of that application for transbasin diversion authorization, the combined capacity of the Choke Canyon/Lake Corpus Christi reservoir system has continued to decline and is now less than 36% of total system storage capacity, causing the City of Corpus Christi and surrounding communities to implement drought contingency measures in order to reduce water demand; and WHEREAS, drought contingency planning also dictates that additional water supplies be made available as soon as possible in order to meet even the minimum water uses of the region under drought contingency conditions; Al�OFILMEG 537 WHEREAS, the continuing need to provide water to meet the public health and safety needs of the area, as well as to protect the economic health of the region, requires that every effort be made to convey the Lake Texana water to the Corpus Christi service area as soon as possible; and WHEREAS, citizens in the Corpus Christi service area are concerned about the continuing drought and the potential shortage of water supplies; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Texas Natural Resource Conservation Commission is urged to approve the proposed amendments to the water rights for Lake Texana at their regular agenda meeting on May 8, 1996, in order to provide for the transbasin diversion and use of water in the Choke Canyon/Lake Corpus Christi service area; and SECTION 2. That elected officials throughout the region served by the Choke Canyon/Lake Corpus Christi reservoir system are urged to express their support for the request by the Lavaca-Navidad River Authority's permit application for the transbasin diversion and area urged to express their support to the Texas Natural Resource Conservation Commission; and SECTION 3. That copies of this resolution be sent to the Executive Director of the Texas Natural Resource Conservation Commission; the President of the Board of Directors of the Lavaca-Navidad River Authority; County Judges in Nueces, San Patricio, Kleberg, Jim Wells, Live Oak, Bee, and Aransas Counties; Texas State Senators and Representatives representing from these same seven counties; the San Patricio Municipal Water District; the South Texas Water Authority; the Alice Water Authority; the City of Mathis; and the Beeville Water Supply District; and other interested officials.
