HomeMy WebLinkAbout022559 ORD - 04/30/1996AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY DOMINGO & ELENA VALADEZ, BY GRANTING A SPECIAL COUNCIL PERMIT FOR A PROFESSIONAL OFFICES SUBJECT TO SIX (6) CONDITIONS ON FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, SECTION 18, 1.00 ACRE OUT OF LOT 29; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Domingo & Elena Valadez, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, March 6, 1996, during a meeting of the Planning Commission and on Tuesday, April 9, 1996, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for professional offices on Flour Bluff & Encinal Farm & Garden Tracts, Section 18, 1.00 acre out of Lot 29, located on the north side of Holly Road, approximately 120 feet east of Sean Drive, subject to the following six (6) conditions: 1. USE: The only use authorized by this Special Permit other than the basic "R -1B" One - family Dwelling District use are the non-residential uses allowed in the "AB" Professional Office District. Development of the property must be in compliance with the attached site plan, Exhibit A, as to setbacks, sideyards, allowable buildable areas, maximum building area and landscaping areas. 2. SCREENING: A standard solid screening fence with a height of at least six (6) feet shall be located along the north, east and west boundary lines of the subject property. Any screening fence extending out to the public right-of-way shall have a height of three (3) feet within twenty (20) feet of that public right-of-way. LIGHTING: All site lighting shall be directional so as to prevent glare to adjacent properties. 4. HEIGHT: Building height is limited to twenty-five (25) feet and one (1) story. 5. LANDSCAPING: Landscaping requirements shall be as for "R -1B" development for non-residential uses. 6. TIME LIMIT Such Special Permit shall be deemed to have expired within one (1) year of the date of this ordinance unless the property is being used as outlined in condition #1 and in compliance with all other conditions. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 36 day of r'1 1 , 1996. Harvey, Director of Planning & Development Zoning Case #396-1; Valadez City Staff hosted a meeting of 3 neighborhood representatives and the applicant to discuss areas of concem regarding the subject zoning case, as requested by Council. The following Special Permit was agreed to with one exception, regarding the allowable uses. The applicant wishes to be allowed any Professional Office use as defined in the Zoning Ordinance. One of the three neighborhood representatives agreed. Two of three neighborhood representatives desire the uses to be limited to medical offices/clinics only. Staff informed the group that limiting the areas to medical offices would generate more traffic than would allowing other professional uses such as engineers; insurance or realtors' offices.
