AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE AN
INTERLOCAL AGREEMENT WITH THE CITIES OF ARLINGTON, AUSTIN,
DALLAS, EL PASO, FORT WORTH, HOUSTON, AND SAN ANTONIO TO
JOINTLY EMPLOY A PERSON TO COORDINATE THE LEGISLATIVE
PACKAGE FOR SAFETY, CRIME, AND LAW ENFORCEMENT FOR THE 75TH
REGULAR LEGISLATIVE SESSION; AND DECLARING AN EMERGENCY.
WHEREAS, the City of Corpus Christi's Mayor is a member of Mayors United on Safety,
Crime, and Law Enforcement (MUSCLE); and
WHEREAS, the members of MUSCLE wish their cities to present a collective safety,
crime, and law enforcement legislative package during the 75th Regular Legislative Session; and
WHEREAS, cooperation and coordination among the members of MUSCLE and their
respective city staffs is necessary to effectively formulate and present a collective safety, crime,
and law enforcement legislative package;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager, or his designee, is hereby authorized to execute an
Interlocal Agreement with the cities of Arlington, Austin, Dallas, El Paso, Fort Worth, Houston,
and San Antonio to jointly employ a person to coordinate the legislative package for safety, crime,
and law enforcement for the 75th Regular Legislative Session, a substantial copy of which is
attached hereto and made a part hereof marked Exhibit "A".
SECTION 2. That the City Manager, or his designee, is authorized to contribute
$2,633.20 by December 31, 1996 to the City of Austin to pay for the joint employee.
SECTION 3. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that thi ordinance is assed and shall take effect upon first reading as an
emergency measure this the tit day of , 1996.

INTERLOCAL COOPERATION AGREEMEN.
This Interlocal Agreement ("Agreement') is entered into by and
between the following cities ("the Parties"):
Arlington, Austin, Corpus Christi, Dallas,
0 Paso, Fort Worth, Houston, San Antonio
WHEREAS, the Mayors of the Parties formed the Mayors United on
Safety, Crime and Law Enforcement (MUSCLE) as an alliance of Texas urban
cities to reduce crime; and
WHEREAS, the members of MUSCLE ("the MUSCLE Members") wish
their cities to present a collective safety, crime and law enforcement legislative
1 package during the 75 74th Regular Legislative Session; and
WHEREAS, cooperation between the Parties to this Agreement is
necessary in order to effectively formulate and present a legislative package on
safety, crime and law enforcement,
WHEREAS. this Agreement is intended to comply with the
requirements of Chapter 791 of the Texas Government Code.
NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE
AS FOLLOWS:
1 Article 1. Purpose. The purpose of this Agreement is to allow the
Parties to coordinate in the formulation and presentation of a legislative package
for safety, crime and law enforcement for the 75th Regular Legislative Session
("the Legislative Package").

Article 2. Citv of Austin Responsibilities.
1 A. a. The City of Austin shall employ one full-time staff
person to provide the following administrative services:
1. Schedule and maintain all calendar activities for
MUSCLE.
2. Schedule meetings between the MUSCLE Members
and state officials.

3. Develop a legislative packageconferei. .s for the
MUSCLE Members for consideration for the 75th
Regular Leaislative Sessio

4. Prepare research documents and presentation
materials for MUSCLE meetinas the L_gicfativc

5. Compile Legislative Package for final review and
approval by MUSCLE Members.
6. Provide monthly reports of activities to all MUSCLE
Members.
Bb. The anticipated expenditure of funds will be to pay the
cost of one employee and associated expenses to provide the administrative
services described above.
Article 3. Responsibilities of Member Cities
1. Allocation of Costs. In consideration for this
Agreement, the Parties agree to contribute a nonrefundable allocated amount to
the City of Austin for performance of this Agreement on or about by January 31st
of each year December -3114994, for a total budget cost of $56.465.11 oer year
$53.776.00.- There will be no penalty for late payment. Costs will be allocated
as follows:

The budget allocation is based upon the population of each party by
jhe 1990 Federal Census.
Each City's duties to pay money to the City of Austin for any purpose
under this Agreement are limited in their entirety by the provisions of this
section. In order to comply with each City's appropriations procedures and

Article XI, action 5 of the Texas Constitution, each City has apprc.,.iated and
allocated the above sum to be used to discharge its duties to pay money under
this Agreement, and no City shall have any obligation to pay any funds
hereunder in excess of the amounts allocated above.
Article 4. Term of Agreement. This Agreement shall be effective en
yeef from January 1. 1996 through December 31. 1996. Uoon expiration of the
initial term. this Aareement shall be automatically renewed for one year
beginning January 1. 1997 through December 31. 1997. subiect to appropriation
of funds by the member cities.
Article 5. Termination. Any party may, upon written notice to all other
parties, withdraw from this Agreement at any time, but shall not be entitled to a
refund of the amount paid to the City of Austin. The terminatina party shall be
relieved of any future payment obligations under this Agreement.
Article 6. If a City ("Party") not listed in Article 3 indicates it wants
to become a member of MUSCLE. the Party must officially notify the Chair
Through written correspondence. The Party must include in that correspondence
She following -
A. A resolution passed by the Party's City Council authorizing
membership: and
B. Adootion of the terms of the Interlocal Cooperation Aareement
Uoon receiving the above. the Chair will notify the members before the next
official MUSCLE meetina of the Party's desire to become a MUSCLE member.
The members will vote at the next official MUSCLE meeting on membership of
the Party. The Party will become a member upon unanimous vote of all present
MUSCLE members or in their absence their official designees who are present.
Upon a unanimous vote the Chair will officially inform the Party in writino that
they are a MUSCLEmember. New members will be expected to pay a
proportionate share of MUSCLE costs and the addition of new cities will not
affect the amounts contributed by other. members.

Article V. Nondiscrimination, The Parties to this Agreement shall
provide all services and activities required by this Agreement in compliance with
the Americans with Disabilities Act of 1990. The Parties shall not discriminate
against any person based on race, religion, color, sex, national origin, age or
disability.

Article 9_8. Amendment, Any change to the provisions of this
Agreement or any attachments to it shall be made by mutual agreement of the
Parties hereto, in writing, and signed by all Parties.
Article 12.8. Legal Authority. The persons signing this Agreement on
behalf of each party do hereby warrant and guarantee that they have been duly
authorized by their City to sign this Agreement on behalf of the City and to bind
the City validly and legally to all terms, performances and provisions in this
Agreement.
Article 1L1-0.Law and Venue, This agreement is governed by the
laws of the State of Texas and venue for any litigation concerning this
Agreement shall be in the City of Austin, Texas.
Article 1114. Leaal Construction. In case any one or more of the
provisions contained in this Agreement shall be held to be invalid, illegal or
unenforceable in any respect, such invalidity, illegality, or unenforceability shall
not affect any other provision thereof and the Agreement shall be construed as if
such invalid, illegal or unenforceable provision had not been contained herein.
Article a4-2.Entire Aareement All oral and written agreements
among the parties to this Agreement relating to the subject matter of this
Agreement that were made prior to the execution of this Agreement have been
reduced to writing and are contained in this Agreement. Any agreement,
covenant, or understanding that is not included in this document has been
superseded by this Agreement.
Article 14 0. Counteroarts, This Agreement may be executed in any
number of counterparts, all of which taken together shall constitute one in the
same instrument, and any of the Parties hereto may execute this agreement by
signing any such counterpart.
