HomeMy WebLinkAbout022602 ORD - 06/18/1996AN ORDINANCE AMENDING THE CORPUS CHRISTI CODE OF ORDINANCES, CHAPTER 6, ANIMAL CONTROL, TO AMEND THE DEFINITION OF RESTRAINT; TO CHANGE THE AGE REQUIREMENTS FOR OBTAINING A LICENSE AND RABIES VACCINATION FROM FOUR MONTHS OLD TO THREE MONTHS OLD; TO CLARIFY ANIMAL COLLAR REQUIREMENTS; TO PROHIBIT OFFERING TO GIVE AWAY AN ANIMAL AS A PRIZE; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND PROVIDING FOR PENALTIES NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Sections 6-2, 6-10, 6-21, 6-22 and 6-30 of the Code of Ordinances, Chapter 6, Animal Control, are hereby amended as follows: Section 6-2. Definitions. Restraint: Any animal securely caged or secured by a leash or lead and under the effective control of a responsible person and obedient to that person's commands, or within the confines of its owner's home or yard which is fully enclosed by a good, secure and substantial fence or tied by a rope or chain that confines the animal to the owner's property. Horses must be kept in stalls, or in pastures or paddocks with acceptable fencing. In addition, a dog shall be deemed under restraint in the following circumstances: (1) When the dog is entered in a bona fide dog show, field trial or exhibition held in the city, while the dog is actually engaged in such show or exhibition. (2) When the dog is accompanied by and in the presence of its owner, master or trainer, while the dog is actually engaged in dog obedience training; provided, the person training such dog has in such person's possession a leash of at least five (5) feet and not more than ten (10) feet in length and of sufficient strength to control the dog. (3) When the dog is used by a blind or deaf person to aid the person in going from place to place within the city. Sec. 6-10. Licensing. (a) Required. It shall be unlawful for any person to own, keep, harbor or have custody or control of any dog or cat over four (4) three (3) months of age within the city without first obtaining a valid license for each such dog or cat as herein provided. ti 02 (e) When to apply. Application for a license must be made within thirty (30) days after obtaining a dog or cat over four (4) three (3) months of age, except that this requirement will not apply to a nonresident individual keeping a dog or cat within the city for no longer than sixty (60) days. Sec. 6-21. Impoundment. (a) Grounds for impoundment. Animals may be impounded by the animal control section in any of the following circumstances: (2) Any dog or cat not having -affix -al -to -its tuft.; wearing a collar affixed with a valid city license tag. Sec. 6-22. Rabies vaccination. (a) It shall be unlawful for any person to own, keep, harbor or have custody or control of a dog or cat over four (4) three (3) months of age within the city, unless such dog or cat has been immunized against rabies by the injection of anti -rabies vaccine by a licensed veterinarian. Sec. 6-30. Animal care. It shall be unlawful to violate the following provisions for animal care: (0 No person shall give away or offer to give away any live animal as a prize for, or as an inducement to enter, any contest, game or other competition, or as an inducement to enter a place of amusement; or offer such animal as an incentive to enter into any business agreement whereby the offer was for the purpose of attracting trade. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication of this ordinance shall be made in one issue of a newspaper of general circulation in the city in accordance with the requirements of the Charter of the City of Corpus Christi after which publication this ordinance shall be in force. SECTION 4. Violations of this ordinance shall be prosecuted under Section 6-1 of the City Code.
