HomeMy WebLinkAbout022619 ORD - 06/25/1996AN ORDINANCE AMENDING THE CODE OF ORDINANCE:;, CITY OF CORPUS CHRISTI, CHAPTER 55, ARTICLE XII, WATER CONSERVATION, SECTIONS 55-155 AND THE WATER CONSERVATION AND DROUGHT CONTINGENCY PLAN REGARDING MEASURES FOR EFFLUENT DISTRIBUTION AND USE OF EFFLUENT BY HOMEOWNERS; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 55, Utilities, Article XII, Water Conservation, Section 55-155(e), Effluent distribution; permit and regulations, and Section 2.2.7 E. of the Water Conservation and Drought Contingency Plan, adopted by the Code of Ordinances, Section 55-156, be amended to read as follows: (e) Rcscrvcd. Notwithstanding subsection (f) of this section. a resident of the City of Corpus Christi may obtain effluent at no charge from a wastewater treatment plant designated by the Wastewater Superintendent. for the irrigation of vegetation dust control. or watering a foundation at the individual's personal residence. Any effluent received under this subsection may not be sold or transferred to another individual or used for commercial purposes. "(1) Before receiving effluent the resident must obtain a permit from the Wastewater Superintendent. or the Superintendent's designee. (2) Prior to receiving a permit. the resident must complete a course of instruction on the handling of wastewater effluent that has been developed by the City's Health Department. "(3) Any container used to receive and transport effluent must have a lid or cap be watertight. and be properly secured to the vehicle. All containers are subject to inspection and approval of the City Health Department or Wastewater Division. "(4) Any effluent received under this subsection must be immediately transported to the personal residence of the individual receiving the effluent and used for the irrigation of vegetation. dust control. or watering a foundation. The effluent may not be stored for future use. "(5) A resident using effluent for the irrigation of vegetation or dust control must post a sign on the property legible from the street stating that effluent is being used on the property. R63601A2.173 2 "(6) Every resident obtaining effluent under this subsection must either: "a. Provide proof of and maintain in force a property liability insurance policy (homeowner/renter) in the amount of three hundred thousand dollars (5300.000.00) per occurrence. Or "b. Sign a form provided by the Superintendent that releases the City of Corpus Christi from any liability resulting from the resident's improper use or transportation of the effluent and agree to hold the City harmless including reimbursing the City for the costs of defending itself SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. A violation of this ordinance or requirements implemented hereunder shall constitute an offense, punishable as provided in Section 1-6 of the City Code of Ordinances. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi, as required by the City Charter of the City of Corpus Christi. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25 day of .JUJ1J , 1996.
