CLOSING AND ABANDONING A 4,558 -SQUARE FOOT PORTION OF A 15 -FOOT
WIDE UTILITY EASEMENT IN LOT 1, BLOCK 2A, OCEAN VIEW ADDITION;
SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; NOT A
GUARANTEE OF FUTURE COUNCIL ACTION TO APPROVE REZONING OR
ALLEY CLOSURE; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 4,558 -square foot portion of a 15 -foot wide utility easement in Lot 1,
Block 2A, Ocean View Addition, shown by plat recorded in Volume 1, Page 11, and Volume 47, Pages 9-10,
of the Map Records of Nueces County, Texas,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI:
SECTION 1. That a 4,558 -square foot portion of a 15 -foot wide utility easement in Lot 1, Block
2A, Ocean View Addition, as shown by plat recorded in Volume 1, Page 11, and Volume 47, Pages 9-10,
of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every
municipal purpose, subject to the following specified conditions as part of closure:
1) That Owner plug and abandon a 16" sanitary sewer line within the utility easement in a
manhole that is located at the propety line between Lots 1 and 2 of Block 2A. Abandonment
treatment will be completed as part of the project construction.
2) That Spohn pay a closure fee in the amount of $18,232.00 for the proposed UE closure.
SECTION 2. That Owner fully understands that this utility easement closure is an accomodation
to a tight construction schedule for the parking garage and does not guarantee approval of the alley closure
or rezoning request scheduled for Council action on August 27, 1996.
SECTION 3. That upon written request of the Mayor or five Council members, copy attached,
to find and declare an emergency due to the need for immediate action necessary for the efficient and
effective administration of City affairs, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances at two regular meeting.�s so that
this finance is p ssed and shall take effect upon first reading as an emergency measure this the /3 Day

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
