HomeMy WebLinkAbout022661 ORD - 08/27/1996ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 55, UTILITIES, ARTICLE XII, WATER CONSERVATION, SECTION 55-156, WATER CONSERVATION AND DROUGHT CONTINGENCY PLAN; DIRECTING IMPLEMENTATION OF PHASE IV OF THE OPERATIONS PLAN FOR THE LAKE CORPUS CHRISTI -CHOKE CANYON RESERVOIR OPERATING SYSTEM; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION WHEREAS, the City Council adopted Ordinance No. 19637 on February 17, 1987, adopting the Water Conservation and Drought Contingency Plan for Corpus Christi; and, WHEREAS, the City's consultants have found based upon use of the Nueces River lower basin model, used for simulating various operating conditions for the Lake Corpus Christi -Choke Canyon reservoir system, that allowing the elevation of Lake Corpus Christi to drop to a minimum elevation of 74 feet within a 12 month period will increase the yield of the reservoir system by an additional 10,000 acre feet over the yield that will be available under the current operating system. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 55, Utilities, Article XII, Water Conservation, Section 55-156, Water Conservation and Drought Contingency Plan, is hereby amended as follows: By revising paragraph2 of Phase IV of the Operations Plan for the Lake Corpus Christi - Choke Canyon Reservoir System on page 116 to read as follows: "PHASE IV - This phase applies after Choke Canyon Reservoir is filled, water user demand exceeds 200,000 acre-feet annually, and developed long-term supply is less than 300,00 acre-feet annually. In order to provide maximum dependable yield of the two reservoirs, the water level in Lake Corpus Christi will be allowed to drop to elevation % Z feet before water is released from Choke Canyon Reservoir in excess of the 2,000 acre-feet per month requirement. When the elevation of Choke Canyon drops to 155 feet, Lake Corpus Christi will be lowered to its minimum elevation." SECTION 2. Notwithstanding the normal requirement that water user demand exceeds 200,000 acre-feet annually, since the City has implemented Condition II of its Water R63707G5.222 022661 s R BLMEP. 2 Conservation and Drought Contingency Plan, the City Manager is authorized to implement Phase IV of the Operations Plan for the Lake Corpus Christi -Choke Canyon Reservoir System. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
