CLOSING AND ABANDONING A 3,574 -SQUARE FOOT PORTION OF AN
EXISTING 15 -FOOT WIDE ALLEY RIGHT-OF-WAY (ROW), LOCATED
BETWEEN LOT 1, BLOCK 2A, AND LOTS 7 THROUGH 11, BLOCK 1,
OCEAN VIEW ADDITION; SUBJECT TO COMPLIANCE WITH THE
SPECIFIED CONDITIONS; THE OWNER REPLATTING THE PROPERTY
WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 3,574 -square foot portion of an existing 15 -foot wide alley right-
of-way (ROW), located between Lot 1, Block 2A, and Lots 7 through 11, Block 1, Ocean View
Addition, shown by plat recorded in Volume 1, Page 11, and Volume 47, Pages 9-10, of the Map
Records of Nueces County, Texas.
WHEREAS, it has been determined that it is feasible and advantageous to the City of
Corpus Christi to abandon said right-of-way, subject to the provisions listed below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That a 3,574 -square foot portion of an existing 15 -foot wide alley right-of-way
(ROW), located between Lot 1, Block 2A, and Lots 7 through 11, Block 1, Ocean View Addition,
as shown by plat recorded in Volume 1, Page 11, and Volume 47, Pages 9-10, of the Map Records
of Nueces County, Texas, is hereby closed for public use and every municipal purpose, subject to
the following specified conditions as part of closure:
1) That Owner abandon an existing 8" sanitary sewer line within the alley ROW at point
of closure. The Owner must construct a manhole at the end of the line that will
remain in service.
2) That Owner reimburse CP&L for any utility relocation costs.
3) That Owner pay a closure fee of $540 for the proposed alley ROW closure and
dedicate sufficient square feet to relocate and construct the alley exit, including a
turning radius sufficient for garbage and other service trucks, as determined by the
City Engineer, subject to approval of the site plan by City Council.
4) That Owner replat the property within 180 days at his expense; provided however,
the City Engineer may extend the time limit for an additional 180 days if extenuating
circumstances outside the Owner's control necessitate an extension.

SECTION 3. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this rdinance isssed and shall take effect upon first reading as an
emergency measure this the Day of it riot' , 1996.
