Home My WebLink About022698 ORD - 09/24/1996AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY ISLAND MARINE SERVICES, BY GRANTING A SPECIAL COUNCIL PERMIT FOR BOAT STORAGE AND BOAT REPAIR SUBJECT TO SIX (6) CONDITIONS ON PADRE ISLAND NO.1, BLOCK 2, LOTS 9A AND 10A; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Island Marine Services, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, August 21, 1996, during a meeting of the Planning Commission and on Tuesday, September 24, 1996, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for boat storage and boat repair on Padre Island No. 1, Block 2, Lots 9A and 10A, located on the west side of South Padre Island Drive (Park Road 22), approximately 320 feet north of Jackfish Avenue, subject to the following six (6) conditions: 1. USE: The only uses authorized by this Special Permit other than the basic `B -2A" Barrier Island Business District, are boat and boat engine repair and outside storage of boats and boat trailers not for sale. The boat repair facility is limited to three (3) repair bays. Boat repairs shall not include fiberglass work, bottom work or body work or repairs on boats in excess of 30 feet. All repair work is to be completed inside. Outside storage of boats and trailers not for sale may not occur within 130 feet of South Padre Island Drive right-of-way. 2. LANDSCAPING: Landscaping must be provided in accordance with Article 27B, Landscape Requirements, for the "B -2A" Barrier Island Business District as if new construction. All plant material must be kept in a healthy, growing condition at all times. SCREENING: A standard screening fence with a minimum height of six (6) feet must be placed along the north, south, and west property lines and easterly edge of the boat and trailer (not for sale) storage yard as shown on the attached site plan. This screening fence may not be located within the street yard. A building wall may be substituted for the screening fence. This screening fence must be installed prior to the issuance of a certificate of occupancy. 4. SPEAKERS: Outside paging, speakers, or telephone bells are prohibited. 5. LIGHTING: All security lighting must be directional lighting and directed away from the residential area. 6. TIME LIMIT Such Special Permit shall be deemed to have expired within one (1) year of the date of this ordinance unless the property is being used as outlined in condition #1 and in compliance with all other conditions. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8.
