HomeMy WebLinkAbout022722 ORD - 10/15/1996RESCINDING ORDINANCE NO. 021381, ADOPTED APRIL 28, 1992, WHICH AUTHORIZED THE SHUTTLE SERVICE AGREEMENT BETWEEN AIRPORT SHUTTLE AND LIMOUSINES SERVICE, INC. FICA CORPUS CHRISTI LIMOUSINES UNLIMITED, INC. AND THE CITY OF CORPUS CHRISTI, ON OCTOBER 18,1996, FOR DEFAULT IN PAYMENT OF RENT, PRIVILEGE FEES, AND CHARGES IF THE DEFAULT HAS NOT BEEN CURED BY PAYMENT IN FULL BY 5:00 PM; AND DECLARING AN EMERGENCY. WHEREAS, Airport Shuttle and Limousines Service, Inc., FICA Corpus Christi Limousines Unlimited, Inc. ("Lessee") has been chronically late in paying its privilege fees and charges; and WHEREAS, Lessee has not paid September or October rent; and WHEREAS, on October 2, 1996 Lessee began removing his vehicles from the Airport and all vehicles were removed by the end of business on October 3, 1996; and WHEREAS, since October 4, 1996 Lessee has not been honoring shuttle reservations for pickups or deliveries or been at the Airport to transport passengers; and WHEREAS, on October 7 and 8, 1996 Lessee has gone to the Airport with his limousines to pick up prearranged passengers, but not the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. That Ordinance No. 021381, adopted April 28, 1992, which authorized the Airport Shuttle Service Agreement between Airport Shuttle and Limousines Service, Inc., FICA Corpus Christi Limousines Unlimited, Inc., is rescinded on October 18, 1996 for default in the payment of privilege fees and charges if the default has not been cured by payment in full by 5:00 p.m. on October 18, 1996. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is,ppssed and shall take effect upon first reading as an emergency measure this the /5-fh day of LI()be.hi , 1996. TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
