HomeMy WebLinkAbout022741 ORD - 11/12/1996AN ORDINANCE AMENDING SECTION 55-50 OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, REGARDING WATER RATES; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERANCE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. WHEREAS, existing water sources for the Corpus Christi region, which have historically come from the Nueces River Basin, have proven unreliable, and Corpus Christi is one of the only major metropolitan areas in the United States that faces the risk of running out of water if the present drought persists in severity; and WHEREAS, it is critical to the Corpus Christi region that new water sources identified as economical and reliable by the City, and confirmed by the Texas Water Development Board in its Trans -Texas Water Program, be developed and placed in service as soon as feasible to protect the health and prosperity of citizens and employers in the region; and WHEREAS, the City Council has a responsibility to the City's customers, within the City limits and the region the City has traditionally served, to assure that the City provides adequate water for the needs of its citizens and employers, both now and in the future, and the City Council is moving forward with the projects it has determined to be in the best interests of the City's customers; and WHEREAS, the cost of new water is necessarily more expensive than present supplies; and WHEREAS, the City has employed qualified rate consultants to review the present design of water rates charged by the City; and WHEREAS, the City Council has determined, based on the reports of the City's rate consultants, reports from City Staff, and deliberations of the City Council, that the design for water rates within the City's water distribution system should be modified to charge all customers the same amount for raw water on a direct pass through basis, and to make related adjustments to insure a fairer system for all customers; and WHEREAS, the City Council finds that the rate structure adopted herein is sufficient, equitable, and consistent in application to each class of customers, and is not unreasonably preferential, prejudicial or discriminatory. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 55, Utilities, Article III, Water Rates and Charges, Section 55-50, on file with the City Secretary, is revised to read as follows: 126372611.318 MICROFILMEL Sec. 55-50. (b) Raw water cost adjustment. The rates for water service established in subsection (a) of this section are subject to adjustment for the actual costs of raw water. The costs of raw water will be passed directly to the consumer based on actual system -wide raw water diversion by adding the raw water cost adjustment to the charges for water service on the customer's water bill. This raw water cost adjustment will be calculated on a monthly basis. The actual methods for computing the raw water cost adjustment for each class of water customer shall be established in a written City Policy approved by the City Manager and filed with the City Secretary. Prior to its effective date, the City Policy must be provided to the City Council. When preparing the City Policy, the Assistant City Manager, Public Works and Utilities shall: (1) Use the annual budgeted cost of debt service proportioned into equal charges over a twelve month period. (2) Expenditures for capital items shall be adjusted as follows: (3) a. The expense of acquiring a capital item that cost not more than $50,000 shall be charged to the month in which the expenditure is made. b. The expense of acquiring a capital item that cost more than $50,000, but not more than $100,000 shall be proportioned into equal charges over a twelve month period. c. The expense of acquiring a capital item that cost more than $100,000 shall be amortized, and the expenses proportioned into equal monthly charges over the number of years used to calculate depreciation expenses. All operating and maintenance expenditures shall be charged in the month the expenditure is made. (4) All expenses for consultants, engineering, and legal services shall be charged to the month in which the expenditure is made. (5) 86372611.318 Expenses related to the acquisition and transportation of emergency water supplies shall be charged to the month in which the expenditure is made. 6 (c) Definitions. "Costs of raw water" is the total of all costs of acquiring, producing, storing, conserving, and transporting untreated water from its source to the City's treatment facility. These costs include, but are not limited to the costs of: Construction, including debt service and contributions to the Choke Canyon Debt Reserve Fund, operation, and maintenance of dams and reservoirs. Construction, including debt service, operation, and maintenance of raw water supply transmission pipelines. Construction, including debt service, operation, and maintenance of wells. Construction, including debt service, operation, and maintenance of facilities capable of converting wastewater effluent, salt water, and brackish ground water into water suitable for municipal, industrial, or agricultural uses. Acquisition of new water supplies and water rights. Payments to the P.L. 104-318 Alternative Water Supply Acquisition and Facilities Construction Special Fund. Construction, operation, and maintenance of facilities to reduce water losses from water resources due to evaporation or the release of water from a reservoir due to the operation of law. Acquisition and transportation of emergency water supplies, including the costs of transporting water by vessel or pipelines from other regions. Water supply development and protection, including consultants' studies and reports, investigations, legal fees, court costs, and any other costs related to the development or protection of the water supply. Administrative costs, including overhead and the portion of the City's general administrative costs applicable to the activities enumerated in this definition. SECTION 2. The method of determining water rates by separating the water bill into two separate elements, the rate for water service, and the costs of raw water adjustment, established in section 1 of this ordinance take effect on and shall be applied to all service provided in a utility reading cycle beginning on or after January 1, 1997. SECTION 3. That the additional rate increases provided in Section 5 of Ordinance 021814 on December 14, 1993, shall apply to the rates for water service in Section 55-50(a) of the Code of Ordinances, as amended by Section 1 of this ordinance. R63726J1.318 7 SECTION 4. That all ordinances and parts of ordinances in conflict with this ordinance are repealed to the extent of the conflict. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 6. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
