CLOSING AND ABANDONING: (1) A 4,000 SQUARE FOOT PORTION OF A
20 -FOOT WIDE ALLEY RIGHT-OF-WAY (ROW) BETWEEN LOTS 1-4 AND
9-12, BLOCK 12, WATER BEACH ADDITION; (2) A 19,200 -SQUARE FOOT
PORTION OF BELDEN STREET FROM SHORELINE BOULEVARD WEST,
APPROXIMATELY 320 -FEET TO WATER STREET; AND (3) A 6,000
SQUARE FOOT PORTION OF A 20 -FOOT ALLEY ROW BETWEEN LOTS 1-6
AND 7-12, BLOCK 11, WATER BEACH ADDITION; SUBJECT TO
COMPLIANCE WITH THE SPECIFIED CONDITIONS; THE OWNER
REPLATTING THE PROPERTY WITHIN 360 DAYS AT THE OWNER'S
EXPENSE; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 4000 -square foot portion of a 20 -foot wide alley ROW between
Lots 1-4 and Lots 9-12, Block 12, Water Beach Addition (Closure 1) between Power Street and
Belden Street, shown by plat recorded in Volume 9, Pages 38-40, of the Map Records of Nueces
County, Texas,
WHEREAS, there exists a 19,200 -square foot portion of Belden Street ROW from Shoreline
Boulevard west for approximately 320 feet to Water Street (Closure 2), shown by plat of Water
Beach Addition recorded in Volume 9, Pages 38-40, of the Map Records of Nueces County, Texas,
WHEREAS, there exists a 6,000 -square foot portion of a 20 -foot wide alley ROW between
Lots 1-6 and Lots 7-12, Block 11, Water Beach Addition (Closure 3) between Belden Street and
Aubrey Street, shown by plat recorded in Volume 9, Pages 38-40, of the Map Records of Nueces
County, Texas.
WHEREAS, it has been determined that it is feasible and advantageous to the City of
Corpus Christi to close and abandon said alleys ROW and street ROW, subject to the provisions
listed below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That a 4000 -square foot portion of a 20 -foot wide alley ROW between Lots
1-4 and Lots 9-12, Block 12, Water Beach Addition (Closure 1) between Power Street and Belden
Street, shown by plat recorded in Volume 9, Pages 38-40, of the Map Records of Nueces County,
Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the
following specified conditions as part of Closure 1:
(1) That City dedicate sufficient alley ROW as a utility easement to serve the Alliance

Building in the replat.
(2) That City abandon a 4 -inch gas line in place.
(3) That City dedicate a utility easement sufficient to accomodate the operation,
maintenance, repair, and replacement of the storm water outfall across Block 12
starting at the Power Street Pump Station.
(4) That City abandon the south 100 feet of an 8 -inch VCP sanitary sewer line in place.
SECTION 2. That a a 19,200 -square foot portion of Belden Street ROW from Shoreline
Boulevard west for approximately 320 feet to Water Street (Closure 2), shown by plat of Water
Beach Addition recorded inVolume 9, Pages 38-40, of the Map Records of Nueces County, Texas,
be and the same is hereby closed for public use and every municipal purpose, subject to the
following specified conditions as part of Closure 2:

That City abandon a 30 -inch drainage structure in place.
That City abandon an 8 -inch sanitary sewer line in place.
That City abandon an 8 -inch and a 10 -inch water line in place.
That City abandon a 4 -inch gas line in place.
SECTION 3. That a 6,000 -square foot portion of a 20 -foot wide alley ROW between Lots
1-6 and Lots 7-12, Block 11, Water Beach Addition (Closure 3) between Belden Street and Aubrey
Street, shown by plat recorded in Volume 9, Pages 38-40, be and the same is hereby closed for
public use and every municipal purpose, subject to the following specified conditions as part of
Closure 3:
(1) That City abandon a 4 -inch gas line in place.
SECTION 4. That Closures 1, 2, and 3 are all subject to the following conditions:

City must install a new 4 -inch gas line in Palo Alto Street to reconnect service for the
immediate area at the Gas Department's expense.
That CPL relocate an existing overhead transmission line along the alley in Blocks
11 and 12, existing overhead facilities that cross Belden Street, and underground
utilities in Belden Street at its expense in an easement dedicated by City in the replat.
That Southwestern Bell Telephone provide alternate service at its expense in an
easement dedicated by City in the replat.
That City must limit obstructions and permanent structures in all utility easements,
except permanent street improvements, and the limitation must appear on the replat.
Since the street and alley closures are being initiated by the City for City purposes,
no fair market value payment is required.
City must replat the property within 360 days at its expense; provided however, the
City Engineer may extend the time limit for an additional 180 days if extenuating

circumstances outside the City's control necessitate an extension.
(6) The Belden Street closure becomes effective upon the determination of necessity of
the Director of Engineering Services after the award of the construction contract to
relocate the westbound lane of IH 37.
SECTION 5. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this ordinance ordinance i passed and shall take effect upon first reading as an
