CLOSING BUT NOT ABANDONING: AN APPROXIMATELY 13,604 -SQUARE
FOOT PORTION OF WATER STREET ROW FROM BELDEN STREET
SOUTH FOR APPROXIMATELY 170 FEET TO THE NORTH ROW LINE OF
THE NEW WESTBOUND LANE OF IH 37; SUBJECT TO COMPLIANCE
WITH THE SPECIFIED CONDITIONS; AND DECLARING AN EMERGENCY.
WHEREAS, there exists an approximately 13,604 -square foot portion of Water Street ROW
between Belden Street, shown by plat of Beach Portion Addition recorded in Volume A, Pages 2-3,
of the Map Records of Nueces County, Texas, approximately 170 -feet south to the North ROW line
of the new Westbound lane of IH 37, (Closure 4),
WHEREAS, it has been determined that it is feasible and advantageous to the City of
Corpus Christi to close but not abandon said ROW, subject to the provisions listed below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That approximately a 13,604 -square foot portion of Water Street ROW, shown
by plat of Beach Portion Addition recorded in Volume A, Pages 2-3, of the Map Records of Nueces
County, Texas, between Belden Street and approximately 170 -feet south to the North ROW line of
the new Westbound lane of IH 37, be and the same is hereby closed for public use and retained for
every municipal purpose, subject to the following specified conditions as part of Closure 4:
(1) The Water Street closure becomes effective upon the determination of necessity of
the Director of Engineering Services after the award of the construction contract to
relocate the westbound lane of IH 37.
(2) Since the street closure is being initiated by the City for City purposes, no fair market
value payment is required.
(3)
City will abandon a 4 -inch gas line in place.
(4) City will retain a 108 -inch horseshoe shaped drainage structure and a 48 -inch
drainage structure, a 21 -inch sanitary sewer line, and a 10 -inch water line in the
closed ROW to operate, repair, maintain, and replace city stormwater, water, and
sanitary sewer facilities.

SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that tllis ordinance 4,passed and shall take effect upon first reading as an
