HomeMy WebLinkAbout022765 ORD - 11/19/1996AN ORDINANCE CLOSING AND ABANDONING ALL THAT PORTION OF A DEDICATED BUT NOT IMPROVED 40 -FOOT WIDE ROAD RIGHT-OF-WAY, WHOSE CENTERLINE IS CONTIGUOUS WITH THE COMMON BOUNDARY LINES OF LOTS 25 AND 26, SECTION 6, AND LOTS 3 AND 4, SECTION 7 FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS AND THAT IS SITUATED IN LOT 1, BLOCK 1, KING'S CROSSING WEST, UNIT 1 AND CLOSING AND ABANDONING ALL THAT PORTION OF A DEDICATED BUT NOT IMPROVED 40 -FOOT WIDE ROAD RIGHT-OF-WAY, WHOSE CENTERLINE IS CONTIGUOUS WITH THE COMMON BOUNDARY LINES OF LOTS 27 THROUGH 30, SECTION 6, AND LOTS 1 AND 2, SECTION 7 FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS AND THAT IS SITUATED IN THE APPROXIMATELY 104.9 ACRES OF 050 CREEK PARKLANDS ACQUIRED BY THE CITY FROM THE RESOLUTION TRUST COMPANY IN 1992. WHEREAS, there exists a portion of a 40 -foot wide undeveloped street right-of-way, whose centerline is contigous with the common boundary lines of lots 25 and 26, section 6, and lots 3 and 4, section 7, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded in Volume A, Pages 41-43, of the Map Records ofNueces County, Texas, and which is situated in Lot 1, Block 1, King's Crossing West Unit I; and WHEREAS, there exists a portion of a 40 -foot wide undeveloped street right-of-way, whose centerline is contigous with the common boundary lines of lots 27 through 30, section 6, and lots 1 and 2, section 7, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas, and which is situated in the approximately 104.9 acres of Oso Creek Parklands acquired by the City from the Resolution Trust Company in 1992; and WHEREAS, these portions of the 40 -foot roadway located between portions of Sections 6 and 7 of the Flour Bluff and Encinal Farm and Garden Tracts as set out above no longer conforms to the Corpus Christi Urban Transportation Plan the City is initiating the closure and abandonment of the portions of undeveloped street right-of-way set out above to facilitate development and to free the City's parklands from the burden of an unnecessary road right-of-way. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said street rights-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: AG5000.125.1a tAlUtUt IOU 2 SECTION 1. That a portion of a 40 -foot wide undeveloped street right-of-way, whose centerline is contigous with the common boundary lines of lots 27 through 30, section 6, and lots 1 and 2, section 7, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas, and which is situated in Lot 1, Block 1, King's Crossing West Unit 1 is hereby closed for public use and every municipal purpose, in order to facilitate development. SECTION 2. That a portion of a 40 -foot wide undeveloped street right-of-way, whose centerline is contigous with the common boundary lines of lots 26 and 27, section 6, and lots 3 and 4, section 7, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas, and which is situated in the approximately 104.9 acres of Oso Creek Parklands acquired by the City from the Resolution Trust Company in 1992 is hereby closed for public use and every municipal purpose in order to free the City's parklands from the burden of an unnecessary road right-of-way.
