Under Corpus Christi City Charter Article X, Section 1(a)(12) and Texas Transportation Code Chapter 313, the city council determines that it is necessary to improve and orders the improvement of the following highways in the city: Del Mar Boulevard --South Staples Street to South Alameda Street Naples Street --15th Street to South Alameda Street Atlantic Street --15th Street to South Alameda Street Southern Street --15th Street to South Alameda Street Louisiana Avenue --Brownlee Boulevard to South Alameda Street Brownlee Boulevard --South Staples Street to Louisiana Avenue Cole Street --Brownlee Boulevard to South Staples Street 15th Street --South Staples Street to Louisiana Avenue 16th Street --South Staples Street to Louisiana Avenue Southern, Atlantic, and Naples Streets between 15th Street and 16th Street Cole Street --Brownlee Boulevard to South Alameda Street Louisiana Avenue --Brownlee Boulevard to Swantner Drive (collectively, the "Del Mar Area Street Improvements --Phase III Project") (the "Project"). As specified in more detail in Project plans and specifications, the Del Mar Area Street Improvements --Phase III Project will include: 1. filling, grading, raising, paving, or repairing the streets in a permanent manner; 2. widening or narrowing various sections of these streets; 3. constructing and realigning curbs, gutters, and sidewalks; and 4. constructing driveways. Additionally, street, curb, gutter, sidewalk, and driveway improvements will be made to marginal access streets located on the south side of Cole Street from Brownlee Boulevard to South MS0922.050 mis(bek) November 21, 1996 (844em) 2 Alameda Street, and on both sides of Del Mar Boulevard from South Staples Street to South Alameda Street. For purposes of this resolution, "highway" includes any part of a street, alley, public place, or square, including a part left wholly or partly unimproved in connection with another street improvement. SECTION 2. The Project consists of 3 categories of improvements: a) street, curb, gutter, and sidewalk improvements to be paid for partly by the city and partly by assessments; b) driveways to be paid for entirely by assessments; and c) other improvements, to be paid for by the city, because either the assessment statute does not apply to these improvements or the city is not making assessments to pay for them. An assessment against abutting property or affected railway property will create a lien on the property and a personal liability and charge against the property owner. If property is exempt from a street improvement assessment lien when the improvements are ordered, then no assessment lien will be created. The owner of the exempt property, however, will be personally liable for an assessment in connection with the property. SECTION 3. To ensure that assessment liens take effect as soon as possible, and to ensure that the liens will apply to the fullest extent even if assessed property is subdivided or sold, the director of engineering services will file a notice of the proposed assessments with the Clerk of Nueces County, Texas. This notice will describe, or describe by reference, each parcel of property abutting the proposed improvements and affected railway property, if any. The notice will be substantially in the form attached to this resolution as Exhibit A. Costs to construct driveways will be paid for entirely by assessments. 3. Property abutting the proposed improvements, and affected railway property, if any, is described in Exhibit A.
