HomeMy WebLinkAbout022795 ORD - 12/17/1996AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A ONE YEAR LEASE WITH TRINITY TOWERS LIMITED PARTNERSHIP, BY AND THROUGH ITS GENERAL PARTNER, ARC CORPUS CHRISTI, INC., TO CONSTRUCT, INSTALL, REPAIR, AND MAINTAIN A FIVE STORY BUILDING THAT WILL HAVE: 1) A FOOTPRINT IN PART OF AN EXISTING STORM SEWER EASEMENT; 2) AN AERIAL FOOTPRINT OVER A UTILITY EASEMENT; 3) AERIAL CORNICE OVERHANGS ABOVE THE CARANCAHUA STREET AND TANCAHUA STREET RIGHTS-OF-WAY; AND (4) A PERMANENT, ENCLOSED, OVERHEAD SKYWAY ACROSS CARANCAHUA STREET CONNECTING TO THE EXISTING TRINITY TOWERS; SETTING A RENTAL FEE OF $893; AUTHORIZING TRINITY TOWERS LIMITED PARTNERSHIP TO ASSIGN THE LEASE TO MLD TEXAS TRUST; AUTHORIZING MLD TEXAS TRUST TO SUBLEASE TO TRINITY TOWERS LIMITED PARTNERSHIP; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is hereby authorized to execute a one year lease with Trinity Towers Limited Partnership, by and through its General Partner, ARC Corpus Christi, Inc., to construct, install, repair, and maintain a five story building that will have: l) a footprint in part of a storm sewer easement; 2) an aerial footprint over a utility easement; 3) aerial cornice overhangs above the Carancahua Street and Tancahua Street rights-of- way; and (4) a permanent, enclosed, overhead skyway across Carancahua Street connecting to the existing Trinity Towers. Trust. SECTION 2. That a rental fee of $893 is established. SECTION 3. That Trinity Towers Limited Partnership is authorized to assign the Lease to MLD Texas SECTION 4. That MLD Texas Trust is authorized to sublease to Trinity Towers Limited Partnership. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular r�eptings so thawhis ordinance is passed and shall take effect upon first reading as an emergency measure this the /7t- day of 13 ( in 1996.
