HomeMy WebLinkAbout023008 ORD - 07/29/1997AN ORDINANCE CLOSING AND ABANDONING a 54,364 -WARE FOOT PORTION OF A 45 - FOOT WIDE DRAINAGE EASEMENT IN LOTS 5 & 6, SECTION 20, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS IN CONSIDERATION OF DEDICATION OF STREETS AND UTILITY EASEMENTS IN THE REPLATTING PROCESS; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE OWNER, A J CONSTRUCTION, INC., REPLATTING THE PROPERTY WITHIN 180 DAYS AT OWNER'S EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 54,364 -square foot portion of a 45 -foot wide drainage easement in Lots 5 and 6, Block 20, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas that A J Construction, Inc. ("Owner") wishes to have closed and abandoned. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to close and abandon said drainage easement, subject to the provisions listed below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 54,364 -square foot portion of a 45 -foot drainage easement in Lots 5 & 6, Section 20, Flour Bluff& Encinal Farm & Garden Tracts ("F.B.&E.F.&G.T.") shown by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas, is hereby closed and abandoned for public use and every municipal purpose, in consideration of dedication by the Owner (A J Construction, Inc.) of streets and utility easements and subject to the following specified conditions as part of closure: 1) That Owner dedicate streets and utility easements through Lots 5 and 6 of Section 20, F.B. & E.F. & G.T. to offset the drainage easement closed herein when the property is replatted, and; 2) That Owner replat Lots 5 and 6 of Section 20, F.B. & E.F. & G.T. within 180 days at their expense, provided however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the Owner's control necessitate an extension. SECTION 2.
