APPROVING, RATIFYING, CONFIRMING, AND ACCEPTING AN
ECONOMIC DEVELOPMENT RATE FILED BY CENTRAL POWER AND
LIGHT COMPANY FOR THE FURNISHING OF SERVICE WITHIN THE
CITY OF CORPUS CHRISTI, TEXAS, BY CENTRAL POWER AND LIGHT
COMPANY
WHEREAS, Central Power and Light Company (CPL) has filed its petition for approval
of an Economic Development Rate with the City of Corpus Christi (City); and
WHEREAS, the proposed Economic Development Rate will aid the City in its economic
development efforts; and
WHEREAS, CPL has indicated that the discounts to be provided under the rate will not be
borne by other CPL customers; and
WHEREAS, a public hearing has been held on CPL's petition; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS, acting in its capacity as a regulatory authority pursuant to
Section 33.001 of the Public Utility Regulatory Act (Tex. Util. Code Ann. § § 11.001-63.063):
SECTION 1. That the request for approval of the Economic Development Rate - Rider 31
is granted.
SECTION 2. That the charges for service under the Economic Development Rate - Rider 31
and availability of said tariff within said City shall be those set forth in the Economic Development
Rate - Rider 31, which is attached hereto.
SECTION 3. Lost revenues, if any, associated with the discounts to be provided under the
rate will be borne by CPL, not other ratepayers.
SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or
provision of this Ordinance shall be held invalid or unconstitutional by final judgment of a court of
competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this Ordinance for it is the definite intent of this City that each of such be given
full force and intent for its purpose.
SECTION 5. This Ordinance and the tariff adopted herein shall be and become effective for
service rendered from and after the date this Ordinance is passed and approved.
SECTION 6. That all Ordinances, Resolutions or parts of Ordinances or Resolutions in
conflict herewith are repealed to the extent of such conflict.
