HomeMy WebLinkAbout023294 ORD - 04/28/1998AN ORDINANCE CLOSING AND ABANDONING A 14,635 -SQUARE FOOT PORTION OF UTILITY EASEMENTS OUT OF LOT 1, BLOCK 1, DEL MAR COLLEGE EAST CAMPUS, SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE OWNER, DEL MAR COLLEGE, REPLATTING THE PROPERTY WITHIN 360 DAYS AT THEIR EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there is a 14,635 -square foot portion of utility easements out of Lot 1, Block 1, Del Mar College East Campus, as recorded in Volume 53, Page 103, of the Map Records of Nueces County Texas, that the Owner, Del Mar College, wishes to have closed and abandoned. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to close and abandon said utility easements for all purposes, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 14,635 -square foot portion of utility easements out of Lot 1, Block 1, Del Mar College East Campus, as recorded in Volume 53, Page 103, of the Map Records of Nueces County Texas, and as described on Exhibits A and B, attached and incorporated herein, is closed and abandoned for public use as a right-of-way, subject to Del Mar College ("Owner") complying with the following specified conditions as part of closure: 1) That Owner pay the fair market value of $7,700 for the proposed 14,635 -square foot portion of utility easements out of Lot 1, Block 1, Del Mar College East Campus being closed; provided, however, that any utility easements dedicated as a result of utility relocations necessitated by this easement closure will offset the fair market value on a square -foot by square -foot basis. 2) That Owner must relocate existing utilities as necessary for Owner's building plans and dedicate sufficient utility easements to accommodate the relocated utilities at Owner's sole expense, as approved by the City's Director of Engineering Services. 3) That Owner must replat Lot 1, Block 1, Del Mar College East Campus, within 360 days at their expense; provided however, the City Engineer may extend the time limit for an additional 360 days if extenuating circumstances outside the Owner's control necessitate an extension. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 41-1-\ day of (,CSL / , 1998.
