CLOSING AND ABANDONING A 14,635 -SQUARE FOOT PORTION OF
UTILITY EASEMENTS OUT OF LOT 1, BLOCK 1, DEL MAR COLLEGE
EAST CAMPUS, SUBJECT TO COMPLIANCE WITH THE SPECIFIED
CONDITIONS AND THE OWNER, DEL MAR COLLEGE, REPLATTING
THE PROPERTY WITHIN 360 DAYS AT THEIR EXPENSE; AND
DECLARING AN EMERGENCY.
WHEREAS, there is a 14,635 -square foot portion of utility easements out of Lot 1, Block
1, Del Mar College East Campus, as recorded in Volume 53, Page 103, of the Map Records of
Nueces County Texas, that the Owner, Del Mar College, wishes to have closed and abandoned.
WHEREAS, it has been determined that it is feasible and advantageous to the City of
Corpus Christi to close and abandon said utility easements for all purposes, subject to the provisions
listed below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That a 14,635 -square foot portion of utility easements out of Lot 1, Block 1,
Del Mar College East Campus, as recorded in Volume 53, Page 103, of the Map Records of Nueces
County Texas, and as described on Exhibits A and B, attached and incorporated herein, is closed and
abandoned for public use as a right-of-way, subject to Del Mar College ("Owner") complying with
the following specified conditions as part of closure:
1) That Owner pay the fair market value of $7,700 for the proposed 14,635 -square foot
portion of utility easements out of Lot 1, Block 1, Del Mar College East Campus
being closed; provided, however, that any utility easements dedicated as a result of
utility relocations necessitated by this easement closure will offset the fair market
value on a square -foot by square -foot basis.
2) That Owner must relocate existing utilities as necessary for Owner's building plans
and dedicate sufficient utility easements to accommodate the relocated utilities at
Owner's sole expense, as approved by the City's Director of Engineering Services.
3) That Owner must replat Lot 1, Block 1, Del Mar College East Campus, within 360
days at their expense; provided however, the City Engineer may extend the time limit
for an additional 360 days if extenuating circumstances outside the Owner's control
necessitate an extension.

SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this ordinance is passed and shall take effect upon first reading as an
emergency measure this the 41-1-\ day of (,CSL / , 1998.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.

Approximate FIELD NOTES for a 0.273 acre tract of land, being a utility easement to be
closed, out of and part of Del Mar College East Campus, Block 1, Lot 1, a map of which is
recorded in Volume 53, Page 103, of the Map Records of Nueces County, Texas; said easement
tract to be closed being more particularly described by Metes and Bounds as follows:
Commencing at a point for the most Northeasterly right-of-way line of Edwards Street at the most
Easterly corner of the intersection of said Edwards Street and Ayers Street, said point being the
point of curvature of a curve from said Northeast line of Edwards street into the most Easterly
right-of-way line of Ayers Street; Thence South 61°42'00" East, a distance of 592.49 feet to a
point in the Westerly line of old Lewis Street, a right-of-way abandoned but retained as Utility
Easement by Ordinance Number 20038 of the City of Corpus Christi, Texas; Thence North
28°20'00" East, a distance of 1589.84 feet to a point for the intersection of said Westerly line of
old Lewis Street and the most Southerly right-of-way line of old Price Street, a right-of-way
abandoned but retained as utility easement by Ordinance Number 2710 of the City of Corpus
Christi, Texas, said point being the POINT OF BEGINNING and most Southerly corner of this
0.273 acre easement to be closed;
THENCE North 61°42'00" West, along and with said Southerly line of Price Street, a distance of
237.88 feet to a point for the most Westerly comer of this easement to be closed;
THENCE North 28°18'00" East, a distance of 50.00 feet to a point in the most Northerly right-of-
way of said Price Street for the most Northerly corner of this easement to be closed;
THENCE South 61°42100" East, a distance of 237.91 feet to a point for the most Easterly comer
of this easement to be closed;
THENCE South 28°20'00" West, a distance of 50-00 feet to the POINT OF BEGINNING and
containing 0.273 acres of land, more or less.

Approximate FIELD NOTES for two tracts of land, both being utility easements to be
closed, the first being 0.048 acres, and the second being 0.015 acres, totaling 0.063 acres of
land out of and part of Del Mar College East Campus, Block 1, Lot 1, a map of which is recorded
in Volume 53, Page 103, of the Map Records of Nueces County, Texas; said easement tracts to
be closed being more particularly described by Metes and Bounds as follows:
Tract 1, 0.048 Acre Utility Easement to Be Closed
Commencing at a point for the most Northeasterly right-of-way line of Edwards Street at the most
Easterly corner of the intersection of said Edwards Street and Ayers Street, said point being the
point of curvature of a curve from said Northeast line of Edwards street into the most Easterly

point in the Easterly line of old Lewis Street. a right-of-way abandoned but retained as Utility

28°20'00" East, a distance of 649.86 feet to a point for the intersection of said Easterly line of old
Lewis Street and the most Northerly right-of-way line of old Tompkins Street. a right-of-way
abandoned but retained as utility easement by said Ordinance Number 20038, said point to be
known hereinafter as Reference Point Number 1; Thence, South 61°42'00° East. a distance of
140.00 feet to the POINT OF BEGINNING and most Northerly comer of this 0.048 acre
easement to be closed:
THENCE South 61°42'00" East, a distance of 130.00 feet to a point for the most Easterly comer
of this easement to be closed;
THENCE South 28°20'00" West, a distance of 16.00 feet to a point for the most Southerly comer
of this easement to be closed;
THENCE North 61°42'00" West, a distance of 130.00 feet to a point for the most Westerly comer
of this easement to be closed;
