HomeMy WebLinkAbout023328 ORD - 06/09/1998AN ORDINANCE CLOSING AND ABANDONING TWO 6,000 -SQUARE FEET, 10 -FOOT WIDE BY 600 -FOOT LONG, UTILITY EASEMENTS BETWEEN LOTS 15 THROUGH 38 OF BLOCK 5 AND LOTS 15 THROUGH 38 OF BLOCK 7, RESPECTIVELY, OF THE LA PASCUA UNIT 2 SUBDIVISION, RECORDED IN VOLUME 13, PAGE 50, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE OWNER, WEST OSO INDEPENDENT SCHOOL DISTRICT, REPLATTING THE PROPERTY WITHIN 180 DAYS AT ITS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there are two 6,000 -square foot, 10 -foot wide by 600 -foot long, utility easements between Lots 15 through 38 of Block 5 and lots 15 through 38 of Block 7, respectively, of the La Pascua Unit 2 Subdivision, recorded in Volume 13, Page 50, of the Map Records of Nueces County, Texas, and that the owner, West Oso Independent School District ("Owner"), wishes to have closed and abandoned. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to close and abandon said utility easements for public use, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That two 6,000 -square foot, 10 -foot wide by 600 -foot long, utility easements between Lots 15 through 38 of Block 5 and lots 15 through 38 of Block 7, respectively, of the La Pascua Unit 2 Subdivision, recorded in Volume 13, page 50, of the Map Records of Nueces County, Texas, are closed and abandoned for public use, subject to Owner complying with the following specified conditions as part of closure: 1) That Owner pay the fair market value of $3,000 for the combined 12,000 -square foot portions of the 10 -foot wide by 600 -foot long utility easements being closed and abandoned. 2) That the Owner must replat the property within 180 days at its expense. The City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside of the Owner's control necessitate an extension. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that fid ordinanc-�s passed and shall take effect upon first reading as an emergency measure this the day of /_J , 1998.
