HomeMy WebLinkAbout023331 ORD - 06/09/1998AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY ROBERT E. SEARCY, BY GRANTING A SPECIAL PERMIT FOR A STORAGE BUILDING SUBJECT TO SIX (6) CONDITIONS TO PADRE ISLES NO. 1, BLOCK 14, LOTS 6B AND 7B; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Robert E. Searcy, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, April 29, 1998, during a meeting of the Planning Commission, and on Tuesday, June 9, 1998, during a meeting of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; and WHEREAS, the City Council has determined that this amendment would best serve public health, necessity, and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended and a Special Permit for a storage building subject to six (6) conditions is granted to Padre Isles No. 1, Block 14, Lots 6B and 7B, located at on the east side of Palmira Avenue, approximately 250 feet south of Marquesa Drive. SECTION 2. That the Special Permit granted in Section 1 of this Ordinance is subject to the following six (6) conditions: 1. USE: The only use authorized by this Special Permit, other than the uses permitted by -right in the `B -2A" Barrier Island Business District, is a storage building. Items to be stored shall not include tractors, dozers, dump trucks, or similar equipment in size or use. 2. FLOOR AREA: The storage building and accessory resident garage shall not exceed a total floor area of 4,140 square feet with the storage area not to exceed 3,240 square feet. 3. OUTSIDE STORAGE: Outside storage of any materials is not permitted. 4. HEIGHT: The maximum height of the top plate on the storage building may not exceed 10 feet. (This will result in the overall height of the building being approximately 24 feet.) Z049812B.147 ICRUFILMEo .1 ')':01, 2 5. LANDSCAPING£: The property must comply with the landscaping requirement for new development of other than a single or two-family residence within a B -2A zoning district, set forth in Article 27B, and the height, area, and bulk requirements in Article 24 and Section 13-5 of the Zoning Ordinance In particular, the `B -2A" landscaping requirements in Section 27B-7.O1.C. apply with the required 20 -foot yard setback. In addition, landscaping material must be installed and maintained to provide screening of the storage building from any public right-of-way. All landscaping material must be kept in a healthy and growing condition at all times. 6. TIME LIMIT: This Special Permit expires one (1) year from the date of this ordinance unless the property is being used for the purpose outlined in Condition 1 and all other conditions have been complied with. SECTION 3. That the official Zoning Map of the City of Corpus Christi, Texas, is amended to reflect the amendment to the Zoning Ordinance in Section 1 of this ordinance. SECTION 4. That the Zoning Ordinance and Zoning Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as changed by this ordinance and any other ordinances adopted on this date, remain in full force and effect. SECTION 5. That to the extent that this amendment to the Zoning Ordinance represents a deviation from the Comprehensive Plan, the Comprehensive Plan is amended to conform to the Zoning Ordinance, as amended by this ordinance. SECTION 6. That all ordinances or parts of ordinances in conflict with this ordinance are expressly repealed. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this oi5 i ance is passed -and shall take effect upon first reading as an emergency measure this the `L "h day of 'COL , , 1998.
