HomeMy WebLinkAbout023354 ORD - 06/30/1998AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A USE PRIVILEGE AGREEMENT WITH THE CALALLEN INDEPENDENT SCHOOL DISTRICT (ISD) TO INSTALL AND MAINTAIN AN AERIAL COMMUNICATIONS CABLE WITHIN PORTIONS OF THE CORNETT DRIVE, REDBIRD LANE, CALALLEN DRIVE, MOUNTAIN TRAIL, RIVER CANYON DRIVE, AND WILDCAT DRIVE STREET RIGHTS-OF-WAY AS SHOWN ON EXHIBIT A TO PROVIDE A COMMUNICATION LINK BETWEEN THE SCHOOL BUILDINGS; ISD MUST EXECUTE A POLE ATTACHMENT AGREEMENT WITH CENTRAL POWER & LIGHT ; AND ESTABLISHING A FEE OF $2,056.50; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is hereby authorized to execute a Use Privilege Agreement with the Calallen Independent School District (ISD) to install and maintain an aerial communications cable within the portions of Cornett Drive, Redbird Lane, Calallen Drive, Mountain Trail, River Canyon Drive, and Wildcat Drive street rights-of-way as shown on Exhibit A. SECTION 2. That the Calallen Independent School District pay consideration of $2,056.50 and comply with the terms and conditions of the Use Privilege Agreement, a copy of which is on file with the City Secretary; and SECTION 3. That the Calallen Independent School District obtain a Pole Attachment Agreement from Central Power & Light for use of the existing power poles. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, do find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance passed and shall take effect upon first reading as an emergency measure this the &'F') day of , 1998.
