HomeMy WebLinkAbout023400 ORD - 07/28/1998AN ORDINANCE AMENDING THE CORPUS CHRISTI CODE OF ORDINANCES, CHAPTER 9, SECTION 9-61, PERMIT FOR AIRPORT GROUND TRANSPORTATION OPERATIONS, BY REVISING THE METHOD OF CALCULATING FEES AND ADDING NEW FEES; PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 1, 1998; PROVIDING FOR REPEAL; AND PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. That the Corpus Christi Code of Ordinances, Chapter 9, Section 9-61, is amended as follows: Sec. 9-61. Permit for ground transportation operations. (a) Except for duly franchised airport shuttle and limousine services, it is unlawful for any person to charge, operate, or drive, for hire or other consideration any vehicle to carry, deliver, pick up any cargo, passenger, freight, or mail at the Corpus Christi International Airport without a valid permit issued by the airport for ground transportation operations ("ground transportation permit"). Each applicant for a ground transportation permit shall register with the airport manager and comply with all rules and regulations set by the Director of Aviation and City of Corpus Christi. Each vehicle permitted under this ordinance must display a current valid Airport permit permanently affixed to the vehicle that shows the activity for which a permit has been issued. If a vehicle is engaged in multiple permitted activities, the vehicle must display a permit for each activit Ai ort may issue color -coded permits that indicate multiple activities are permitted in lieu of multiple permits.] A person can only operate a vehicle for activities for which it has been permitted. If a person is operating a vehicle for an activity for which the vehicle has not been permitted, all permits for that vehicle and the owner of that vehicle will be revoked pending an appeal to the Director of Aviation or designee "Director of Aviation". (b) Except for franchised airport shuttle and limousine service, each person operating a ground transportation service at the airport must pay permit fees as set forth in the following schedule, which will be recalculated each December to set the monthly payments for the next calendar year. Permits may be purchased yearly, monthly, or prorated for any portion of the current calendar year.t (1) AGA98\5000.436 Taxicabs, the fee per vehicle is the product of $0.018 times the total number of enplaned and deplaned revenue passengers for the preceding year divided by twelve (12) months divided by the average number of permitted taxicabs for the preceding year. Off -airport rental car and parking lot courtesy vehicles "rent-ettr/parking Courtesy Vehicles", the fee per vehicle is the product of $0.05 times the total number of enplaned and deplaned revenue passengers for the preceding year divided by twelve (12) months divided by the average number of permitted rent car/parking courtesy vehicles for the preceding year. (E.g. 994,4711.000,000 passengers for 19971996 x $0.05 - 12 months _ 823 average number of permitted rent car/parking courtesy vehicles for 19971996 = $518$167 per month per rent car/parking courtesy vehicle.) (4) Cargo/freight, luggage, .: .: and all other companies whose primary business is pick up and delivery services and make 20 or more pick up and deliveries per month to the Airport "Pick up/Delivery Vehicles", the fee for up to 3 vehicles pervchiele is the product of $0.01 per pound of cargo times the total pounds of cargo for the preceding year divided by 12 months divided by the average number of permitted pick up/delivery vehicles for the preceding year. (e.g. 7,607,085 1,000,006 pounds of cargo for 1997 1996 x $0.01 _ 12 months = 43 23 average number of permitted pick up/delivery vehicles for 1997 1996 = $147 33 per month for up to 3 permits . Each additional vehicle is $50 per month per vehicle. (55.1 The fee for miscellaneous cargo/freight pick up/delivery vehicles that routinely make less than 20 pick up and deliveries monthly to the Airport is $20 per month. (0) The fee for each private charter bus/luxury limousine, luxury automobile, van "Charter Vehicle" is as follows: (a) less than fifteen (15) nine (9) passengers $15 for up to 3 arrivals for passenger pick up per calendar month : :. ' • : : • :: i.. - - _ - - at the airport; (b) fifteen (15) nine (9) or more passengers, $50 for un to 3 arrivals for passenger pick up per calendar month :: .. at the airport; (c) if a Charter Vehicle makes more than 3 arrivals for passenger nick up per calendar, another monthly permit must be purchased under (a) or (b) above. Private charter companies must make advance arrangements with the airport administration office prior to arrival at the airport. AG\98\5000436 2 The fee for each non -permitted out-of-town taxicab is $2 per arrival for pick up of passengers at the Airport. Each non -permitted out-of-town taxicab must make arrangements with the Airport Administration Office at least fifteen minutes prior to arriving at the Airport. ( Only persons whose taxicabs have been issued and currently display a valid Airport taxicab permit are authorized to make prearranged in -town or contract pick ups at the Airport. Persons with Airport Taxicab Vehicle permits must at the time of application and at all times the permit is in effect, provide written proof of contracts with all businesses or organizations, must show the contract to the Director of Aviation whenever requested and must provide immediate written changes to the Director of Aviation. (c) The director of aviation or successor official will shall issue ground transportation permits, enforce all rules and regulations with respect to ground transportation services, and collect applicable permit fees. If Should any permit holder fails to comply with applicable rules, regulations, and ordinances, such permit holder will shall be issued a notice of noncompliance. If Shottld the violation persists for ten (10) days after the issuance of said notice, the director of aviation may revoke the permit and such permit holder may be prohibited from conducting further operations on airport property. SECTION 2. This ordinance becomes effective August 1, 1998. SECTION 3. That all ordinances, or parts of ordinances, in conflict herewith are repealed to the extent of such conflict. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, work, or provision of this ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, work, or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, clause, phrase, work, or provision hereof shall be given full force and effect for its purpose.
