HomeMy WebLinkAbout023470 ORD - 10/27/1998AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A USE PRIVILEGE AGREEMENT WITH CITGO REFINING AND CHEMICALS COMPANY L.P., TO CONSTRUCT, INSTALL, OPERATE, AND MAINTAIN AN UNDERGROUND CONCRETE DUCT BANK MEASURING 19 -INCHES HIGH BY 36 -INCHES WIDE BY 80 -FEET LONG WHICH WILL CONTAIN EIGHT (8) 4 -INCH PVC CONDUITS, CROSSING THE NUECES BAY BOULEVARD RIGHT-OF-WAY AT APPROXIMATELY 158 FEET SOUTH OF THE JOHN STREET CENTERLINE RIGHT-OF-WAY; ESTABLISHING A FEE OF $1,840; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. That the City Manager, or his designee, is authorized to execute a Use Privilege Agreement with CITGO Refining and Chemicals Company L.P. , ("Owner") to construct, install, operate, and maintain an underground concrete duct bank measuring 19 -inches high by 36 - inches wide by 80 -feet long which will encase and contain eight (8) 4 -inch PVC conduits, crossing the Nueces Bay Boulevard right-of-way at approximately 158 feet south of the John Street centerline right-of-way, subject to Owner complying with the following specified conditions as part of the Use Privilege Agreement: 1) That Owner pay a Use Privilege Agreement one time fee of $1,840 for the right to construct, install, operate, and maintain an underground concrete duct bank and (8) 4" PVC conduits within the Nueces Bay Boulevard street right-of-way. 2) That Owner position a duct bank so that a minimum 3 -foot cover in depth is maintained between the top of the duct bank and the surface elevation. 3) That Owner maintain a clearance of 18 inches between the duct bank and any existing water lines. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is pfA shed d shall take effect upon first reading as an emergency measure this the ani -h day of J (d I/ , 1998.
