BY THE TEXAS DEPARTMENT OF PROTECTIVE AND REGULATORY
SERVICES FOR ANNUAL LICENSING; EFFECTIVE JANUARY 1, 1999;
PROVIDING FOR SEVERANCE AND PROVIDING FOR PUBLICATION.

WHEREAS the Texas De sartment of Protective and Re ' ulato Services licenses da care
centers and group day care homes.
WHEREAS. the Texas Department of Protective and Regulatory Services requires an annual
inspection of day care centers and group day care homes by a local or state sanitation official in
accordance with Title 40 Texas Administrative Code Sections 715.424 and 715.615 -
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Corpus Christi Code of Ordinances, Chapter 23, Health and
Sanitation is hereby amended by the addition of Section 23-22 to establish an inspection fee of $35
for annual health inspections of child carc homes and foster care homes day care centers and group
day care homes as required by the Texas Department of Protective and Regulatory Services for
annual licensing.

homes day care centers and group day care homes.

fa) Definitions. In this section:
(1) The term "Day Care" means the care supervision, and guidance of a child or children
under 14 years of age unaccompanied by a parent, guardian or custodian on a regular basis
for a period of less than 24 hours per day and in a place other than the child's own home.

(2) The term "Day Care Center" means any facility. whether or not known or
incorporated under descriptive titles or names such as "Nursery school", "Kindergarten"
"Play School". "Child Development Center", or "Early Childhood Center". which provides
Day Care for 13 or more children under 14 years old.
O The term "Group Day Care Home" means any facility which provides Day Care for
7 to 12 children under 14 years old.
(b) An inspection fee of $35 shall be charged for inspections of Day Care Centers or Group
Day Care Homes performed by the City -County Health Department which are required by
the Texas Department of Protective and Rei ulato Services for annual licensing of these
facilities.
SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or
provision of this resolution shall be held invalid or unconstitutional by final judgment of a court of
competent jurisdiction, it shall not effect any other section, paragraph, subdivision, clause, phrase,
word or provision of this resolution. It is the definite intent of this City Council that every section,
paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for
its purpose.
SECTION 3. Publication will be made one time in the official publication of the City of
Corpus Christi by publishing the caption stating in substance the purpose of the ordinance. This
ordinance will be effective on January 1, 1999.
