AS AMENDED, SECTION 951.0, PLAN I EMPLOYEES, SUBSECTION 951.14, DISABILITY INCOME PROTECTION PLAN, TO PROVIDE AUTHORITY FOR THE CITY MANAGER TO SET SHARED PREMIUM CONTRIBUTIONS ON A PERCENTAGE BASIS; PROVIDES FOR SEVERANCE; AND DECLARES AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance 8127, as amended, Section 951.0, Plan I employees, Subsection 951.14, Disability Income Protection Plan, be amended to read as follows: 951.14 Disability Income Protection Plan Plan I Employees will automatically be members of the City's Disability Income Protection Plan and eligible to apply for extended benefits under that plan provided that employees age 65 at the date of hire, and employees who have reached the age of 65 while participating in Plan I, shall have the option to decline or discontinue participation. The Risk Manager shall be the administrator of the Plan on behalf of the City and member employees. The employee's cost of basic membership in the plan will be paid for equally by the City and the member employee. Any Effective February 1, 1999 both the member employee and the City will share in the cost of any level of coverage on a percentage basis as defined by the City Manager. SECTION II: If for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 923520 SECTION III: That upon written request of the Mayor or five Council Members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such findings of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this Ordinance is passed and shall take effect upon first reading as an emergency measure.
