HomeMy WebLinkAbout023538 ORD - 01/19/1999AN ORDINANCE AMENDING ORDINANCE 8127, AS AMENDED, TO CHANGE LANGUAGE FROM BI -WEEKLY PAY -PERIOD REFERENCES TO MONTHLY BASIS IN SECTION 950, LEAVES OF ABSENCE, SUBSECTION 951.1, LEAVE PLAN I, AND SUBSECTION 952.1, LEAVE PLAN II, IN THE FOLLOWING SUBSECTIONS: 951.1 (A) AND (13); SUBSECTION 951.4 (A) AND (B); 951.9 (A) AND (B); SUBSECTIONS 952.9; AND 952.11; IN ADDITION IN SUBSECTION 952.1, DELETE SUBSECTIONS (A), (B), AND (C), AND REPLACE THEM WITH A NEW SUBSECTION 952.1 TO CLARIFY ACCRUAL RATES FOR PLAN II EMPLOYEES, WHICH ARE THE SAME RATES AS PLAN I EMPLOYEES RECEIVE, AND TO CHANGE REFERENCES FROM BI -WEEKLY PAY PERIOD BASIS TO MONTHLY BASIS FOR VACATION ACCRUAL OF LEAVE PLAN II EMPLOYEES; AND PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan I, Subsection 951.1(a), Vacation Leave Accrual, and (b), Vacation Leave Accrual for Airport Public Safety Officers, is amended to read as follows: 951.1 (a) Vacation Leave Accrual. Plan I Employees, except for Airport Public Safety Officers who work a shift of 24 hours on and 48 hours off, earn vacation leave +: , monthly based on 173.3 designated base hours (52 weeks times 40 hours, divided by 12 months), or if less than 173.33 base hours are designated monthly on a pro -rated basis. That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan I, Subsection 951.4(a), Accumulation and Carryover of Vacation Leave and (b), Accumulation and Carryover of Vacation Leave for Airport Public Safety Officers is amended to read as follows: 951.4(a) Accumulation and Carryover of Vacation Leave. Vacation leave credit may be accumulated by Plan I Employees, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off, to a maximum of 240 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 240 hours as of the last pay -period day of the month of the calendar year will be deleted if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance, work requirements, or for other purposes deemed beneficial to the City Service. 951.4(b) Accumulation and Carryover of Vacation Leave for Public Safety Officers. Vacation leave credit may be accumulated by Airport Public Safety Officers, who work shifts of 24 hours on and 48 hours off, up to a maximum of 360 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 360 hours as of the last pay period day of the month of the calendar year will be forfeited if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance, work requirements, or for other purposes deemed beneficial to the City Service. SECTION 3. That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan I. Subsection 951.9 (a) Sick Leave Accrual and Accumulation and (b), Sick Leave Accrual and Accumulation for Airport Public Safety Officers is amended to read as follows: 951.9 (a) Sick Leave Accrual and Accumulation. All eligible Plan I Employees, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off, earn and are allowed sick leave at the rate of 96 hours for each year of continuous service, accrued w. thy. La3i3 of 26 bi eekly pay p,.monthly. Sick leave may be accumulated to a maximum of 960 hours. 951.9(b) Sick Leave Accrual and Accumulation for Airport Public Safety Officers. All eligible Airport Public Safety Officers who work a shift of 24 hours on and 48 hours off, earn and are allowed sick leave at the rate of 144 hours for each year of continuous service, accrued en is monthly. Sick leave may be accumulated to a maximum of 1,440 hours. SECTION 4. That Ordinance 8127, as amended, Section 950, Leaves of Absence, subsection 952.0, Leave Plan II Subsections 952.1(a), (b), and (c) be deleted as indicated and replaced by a new Subsection 952.1. Vacation Leave Accrual, to read as follows: 952.1 Effective August 1, 1982. all Plan II Employees who are eligible to accrue vacation leave shall earn such leave on the basis of 173.33 base hours monthly (52 weeks times 40 hours, divided by 12 months). or if less than 173.33 base hours per month are designated. on a pro -rated basis. That Ordinance 8127, as amended, Section 950, Leaves of Absence Subsection 952.0 Leave Plan II. Subsection 952.9, Mandatory Annual Use of Vacation Leave is amended to read as follows: 952.9 Mandatory Annual Use of Vacation Leave. Because vacation leave is a benefit for employees to provide paid time away from work for purposes of relaxation, personal development, and enjoyment of life, and because Plan II Employees may accumulate vacation leave without limit, all Plan II employees are required to take a minimum of forty (40) working hours of accrued vacation leave before the last day of the calendar year as vacation or forfeit that portion of vacation leave, up to 40 hours, which is not taken. That Ordinance 8127, as amended, Section 950, Leaves of Absence Subsection 952.0, Leave Plan II Subsections 952.11, Sick Leave is amended to read as follows: 952.11 Sick Leave. Plan II Employees shall accrue and be allowed sick leave with pay at the rate of 96 working hours for each year of continuous service to be accrued monthly n `' 66 SECTION 7. If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
