AMENDING THE CITY OF CORPUS CHRISTI PRESERVATION PLAN,
AN ELEMENT OF THE COMPREHENSIVE PLAN, BY ADDING TWO
APPENDICES THAT CATALOG PROPERTIES THAT HAVE HC ZONING
DESIGNATIONS AND PROPERTIES THAT HAVE BEEN DESIGNATED
AS POTENTIAL LANDMARKS; DESIGNATING 27 PROPERTIES AS
POTENTIAL LANDMARKS; PROVIDING FOR SEVERANCE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, the Section 28A-11.01.01 of the City's Zoning Ordinance requires the Preservation
Plan to identify and catalog buildings, structures, sites, districts, areas, lands and other objects of
special architectural, historical, archeological, or cultural value, as properties identified as
Landmarks or Potential Landmarks, along with statement of fact, which verify their significance;
and
WHEREAS, the City Council in Ordinances 14316, 14317, 14691, and 17330 zoned four
properties, including Bayview Cemetery, Artesian Park, the Westergren House, and Heritage
Park with "HC" Historical -Cultural Classifications; and
WHEREAS, the Landmark Commission held a public hearing on Thursday, June 25, 1998, to
meet with property owners to discuss Staffs presentation explaining the purpose of the Potential
Landmark Designation; the impact of the designation on their property; and to receive input and
direction to Staff from property owner to either continue the listing of their property or to remove
it from the list; and
WHEREAS, the property owners were notified, by mail, of the public hearing; and
WHEREAS, after the public hearing, the property owners were requested, by letter, to consider
listing their property as a Potential Landmark; and
WHEREAS, twenty seven (27) property owners responded to the City Staff, in writing, and
agreed to list their property as a Potential Landmark; and
WHEREAS, the Planning Commission received a report from the Landmark Commission
recommending designation of 27 properties as Potential Landmarks; and
WHEREAS, the Planning Commission held a public hearing on Wednesday, November 11,
1998, to receive comments from the public on whether the 27 properties should be designated as
Potential Landmarks; and
WHEREAS, with proper notice to the public, a public hearing was held on Wednesday,
December 9, 1998, during a meeting of the Planning Commission, to consider this proposed
amendment to the Preservation Plan; and

WHEREAS, the Planning Commission has forwarded to City Council its reports and
recommendations concerning designation of the 27 properties as potential landmarks and on this
proposed amendment to the City's Preservation Plan; and
WHEREAS, on Tuesday, January 19, 1999, during a meeting of the City Council, in the Council
Chambers, at City Hall, in the City of Corpus Christi, the City Council held a public hearing on
the proposed designation of the 27 properties as potential landmarks and on this proposed
amendment to the City's Preservation Plan, during which all interested persons were allowed to
appear and be heard on the ;
AND WHEREAS, the City Council has determined that this amendment to the Preservation
Plan would best serve public health, necessity, and convenience and the general welfare of the
City of Corpus Christi and its citizens.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. The City of Corpus Christi Preservation Plan, an Element of the Comprehensive
Plan, is amended by adding Appendix A, Catalog of Designated Landmarks, a copy of which is
attached to the ordinance.
SECTION 2. The City of Corpus Christi Preservation Plan, an Element of the Comprehensive
Plan, is amended by adding Appendix B, Catalog of Potential Landmarks, a copy of which is
attached to the ordinance.
SECTION 3. The 27 properties listed in Appendix B, Catalog of Potential Landmarks, of the
City of Corpus Christi Preservation Plan are designated as Potential Landmarks and the
provisions of Section 28A-7.01 of the Zoning Ordinance apply to the demolition or removal of
the Potential Landmark or its permanent landscaping.
SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or
provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court
of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance, for it is the definite intent of this City Council that
every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full
force and effect for its purpose.
SECTION 5. Publication shall be made in the official publication of the City of Corpus Christi
as required by the City Charter of the City of Corpus Christi.
