APPROVAL OF ORDINANCE AMENDING ORDINANCE 8127, AS AMENDED, TO PROVIDE FOR AN "EXECUTIVE PAY PLAN" BY ADDING A NEW SUBSECTION 520, EXECUTIVE PAY PLAN FOR FY 98-99, EFFECTIVE JANUARY 18, 1999, SETTING FORTH MINIMUM AND MAXIMUM SALARY RANGES FOR ALL POSITIONS DESIGNATED WITHIN THE EXECUTIVE PAY PLAN AS STATED IN EXHIBIT A ATTACHED HERETO. APPROVAL OF ORDINANCE AMENDING ORDINANCE 8127, AS AMENDED, TO PROVIDE FOR A REVISED "MANAGERIAL GROUP PAY PLAN," IN SECTION 500 BY REPLACING SUBSECTION 510, MANAGERIAL GROUP PAY PLAN FOR FY 1998-99, EFFECTIVE DECEMBER 7, 1998, WITH A REVISED MANAGERIAL GROUP PAY PLAN, EFFECTIVE JANUARY 18, 1999, SETTING FORTH MINIMUM AND MAXIMUM SALARY RANGES FOR ALL POSITIONS DESIGNATED WITHIN THE MANAGERIAL GROUP PAY PLAN, AS STATED IN EXHIBIT B ATTACHED HERETO. APPROVAL OF ORDINANCE AMENDING ORDINANCE 8127, AS AMENDED, TO PROVIDE FOR AN "EXECUTIVE PAY PLAN" BY AMENDING THE FOLLOWING SECTIONS AND SUBSECTIONS: SECTION 500, SUBSECTION 509; SECTION 550, SUBSECTIONS 551.1, 551.5, 551.7; SECTION 552, SUBSECTION 552.3; SECTION 700, SUBSECTIONS 707.1 and 711; SECTION 950, SUBSECTIONS 951.3 AND 951.10 FOR LEAVE PLAN I EMPLOYEES, AND SUBSECTION 952.8 FOR LEAVE PLAN II EMPLOYEES; SECTION 955, SPECIAL LEAVE, SUBSECTION 955.21, BE AMENDED AND MOVED TO SECTION 700, SPECIAL COMPENSATION PROVISIONS, SUBSECTION 712; AND PROVIDE FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance 3658, as amended, Section 100, DEFINITION AND ADOPTION OF CLASSIFICATION PLAN, Subsection 103, Adoption of the Classification Plan be amended to read as follows: =223553 Page 2 of 6 103 Adoption of the Classification Plan The classes of positions, as set forth in Section 250 of this Article and the specification for the respective classes, are hereby adopted and shall constitute the Classification Plan on the basis of which all positions in the Classified Service shall be Classified. Classified positions and incumbents thereof shall be subject to Civil Service in accordance with State law, the City Charter, and Ordinances. Exemptions from the Classified Service include: (a) all positions included in the "Executive Pay Plan" under Section 520 of the Compensation Plan Ordinance 8127 as amended- (a)- (b) all positions included in the "Managerial Group Pay Plan" under Section 510 of Compensation Plan Ordinance 8127, as amended; August 1, 1991, or thereafter (-b) (c) each position, regardless of class title or grade, filled by an employee who functions as the principal secretary to any of the following positions: City Manager, Deputy City Manager, Group Manager, Assistant City Manager, Municipal Court Judge, Municipal Court Administrator, Department Director, er Assistant Department Director, Division -Head, City Secretary, City Attorney; and Assistant City Attorney; and -(c3 (d) all members of the Fire and Police Collective bargaining units; and (d) (e) temporary employees as defined in Section 653. Except members of the Fire and Police collective bargaining units, exempt officers and employees serve at will, at the pleasure of the City Manger, or designee, or at the pleasure of the City Council if appointed by the City Council, and shall have and continue such at will status notwithstanding any other provision of this Classification Plan, any other City Ordinance, or any Rule or Regulation of the City or any of its agencies. SECTION 2: That Ordinance 8127, as amended, Section 500, DEFINITION AND ADOPTION OF CLASSIFICATION PLAN, Subsection 509, Application of the Compensation Plan to Positions in the Unclassified Service, be amended to read as follows: 509 Application of the Compensation Plan to Positions in the Unclassified Service The City Council shall, in cooperation with the City Manager, at the beginning of each fiscal year, establish the salary ranges for the Executive Pay Plan and the Mmanagerial Ggroup Pay Plan and other positions in the unclassified and classified service by fixing the minimum and maximum amounts for those positions, and furthermore, these ranges shall remain constant during that fiscal year unless otherwise authorized by the City Council in cooperation with the City Manager. Page 3 of 6 SECTION 3. That Ordinance 8127, as amended, be amended by amending Section 500, DEFINITION AND ADOPTION OF THE CLASSIFICATION PLAN, by adding a new Subsection 520, Executive Pay Plan for FY 98-99, setting forth minimum and maximum salary ranges for all positions designated within the Executive Pay Plan, effective January 18, 1999, as stated in Exhibit A. SECTION 4. That Ordinance 8127, as amended, Section 500, DEFINITION AND ADOPTION OF THE CLASSIFICATION PLAN, Subsection 510, Managerial Group Pay Plan for FY 1998-99, effective December 7, 1998, be amended effective January 18, 1999, as stated in Exhibit B. SECTION 5. That Ordinance 8127, as amended, Section 550, ADMINISTRATION OF THE COMPENSATION PLAN, Subsection 551.1, Starting Rate on Initial Employment, be amended to read as follows: 551.1 Starting Rate on Initial Employment. On original appointment to any position classified in Salary Grades 8 through 17, salary advancement within the range of a Grade shall be based upon performance. The City Manager may approve initial compensation for positions in Grades 8 through 17 at any rate between the minimum and MIDPOINT of the range in the appropriate Salary Grade when the experience, skill, training or labor market conditions justify the action. The City Manager may approve initial compen- sation in Salary Grades 18 through 43 at any rate between the midpoint and the maximum of the range in the appropriate Salary Grade when exceptional experience, training or labor market conditions justify the action and to any salary amount between the minimum and maximum annual salary range for positions in the Executive Pay Plan and the Managerial classifications Group Pay Plan. SECTION 6: That Ordinance 8127, as amended, Section 550, ADMINISTRATION OF THE COMPENSATION PLAN, Subsection 551.5, Rate of Pay on Promotion, be amended to read as follows: 551.5 Rate of Pay on Promotion. In any case where an employee is promoted to a classification with a higher grade designation, with the exception of positions in the Executive Pay Plan and the Managerial Group Pay Plan, the entrance salary rate shall be at a rate within the range of the higher grade which will provide an increase over the salary received immediately prior to such promotion. Such increase in salary rate may be authorized up to the lowest rate in the higher grade which results in a minimum increase of 5% up to a maximum increase of 10% over the salary received immediately prior to the promotion. Subsequent advancement within the range of the grade will be on the same basis as described in Section 552. Salary levels resulting from appointments to Council -appointed positions within the Executive Pay Plan Managerial Croup shall be determined solely by the City Council. Page 4 of 6 SECTION 7: That Ordinance 8127, as amended, Section 550, ADMINISTRATION OF THE COMPENSATION PLAN, Subsection 551.7, Classification/Title Changes Within the Managerial Group, be amended to read as follows: 551.7 Classification/Title Changes Within the Executive Pay Plan and the Managerial Group Pay Plan At the beginning of each fiscal year, the City Council, upon recommendation of the City Manager, shall set minimum and maximum salary ranges for each position assigned to the Executive Pay Plan and the Managerial Group Pay Plan. Throughout the fiscal year, employee salary levels, appointments, reclassification, and title changes within the Executive Pay Plan and the Managerial Group Pay Plan, with the exception of Council -appointed positions, shall be determined by the City Manager provided such changes are made within the salary ranges that have been authorized in cooperation with the City Council and within the appropriation of total salaries funded for the fiscal year. The City Manager shall promptly notify the City Council of actions taken ointments, 551.7 (b) The City Manager shall promptly notify the City Council of actions taken on appointments reclassifications and title changes within the Executive Pay Plan. SECTION 8: That Ordinance 8127, as amended, Section 552, ADVANCEMENT OF SALARY WITHIN A SALARY SCHEDULE, Subsection 552.3, be amended to read as follows: 552.3 Salary advancement within the Executive Pay Plan and the Managerial Group Pay Plan Salary advancement within the Executive Pay Plan and the Managerial Group Pay Plan with the exception of Council -appointed positions shall be made at the sole discretion of the City Manager based upon review of job performance. SECTION 9: That Ordinance 8127, as amended, Section 700, SPECIAL COMPENSATION PROVISIONS, Subsection 707.1 be amended to read as follows: 707.1 The City shall pay 100% of the cost of $50,000 term life insurance for all employees classified within the Executive Pay Plan and the Managerial Group Pay Plan with the exception of Police and Fire Executive Pay Plan and the Managerial Group Pay Plan classifications which shall be covered by Police and Fire Collective Bargaining Agreements. Additional term life insurance shall be made available to these employees on an optional basis at personal expense not to exceed the limitation of coverage authorized by state law. Page 5 of 6 SECTION 10: That Ordinance 8127, as amended, Section 700, SPECIAL COMPENSATION PROVISIONS, Subsection 711, City Manager's Compensation, be amended to read as follows: 711 The compensation and other terms and conditions for the position of City Manager shall be established by resolution or motion of the City Council. Provisions of the City's Compensation and Classification Plan governing the Executive Pay Plan Managerial Croup employees shall apply to the City Manager unless provided otherwise in said resolution or motion. SECTION 11: That Ordinance 8127, as amended, Section 950, LEAVES OF ABSENCE, Subsection 951.0, Plan I Employees, Subsection 951.3, Advance Vacation Leave for Managerial Group, and 951.10, Sick Leave for Managerial Group, be amended to read as follows: 951.3 Advance and Set Accrual Rate for Vacation Leave for Executive Pay Plan and Managerial Group Pay Plan Employees The City Manager shall have authority to grant advance vacation days and establish the rate of accrual for vacation leave for Plan I Employees in the Executive Pay Plan and the Managerial Group Pay Plan. 951.10 Advance and Set Accrual Rate for Sick Leave for Executive Pay Plan and Managerial Group Pay Plan Employees The City Manager shall have the authority to grant advance sick leave days and to establish the rate of accrual for sick leave for all Plan I employees in the Executive Pay Plan and Managerial Group cmployccs Pay Plan. SECTION 12: That Ordinance 8127, as amended, Section 950, LEAVES OF ABSENCE, Subsection 952.0, Plan II Employees, Subsection 952.8, Advance Vacation Leave for Managerial Group, be amended to read as follows: 952.8 Advance and Set Accrual Rate for Vacation and Sick Leave for Executive Pay Plan and Managerial Group Pay Plan Employees The City Manager shall have authority to grant advance vacation and sick leave days and establish the rate of accrual for vacation and sick leave for employees in the Executive Pay Plan and Managerial Group Pay Plan cmployccs. Page 6 of 6 SECTION 13: That Ordinance 8127, as amended, Section 955, SPECIAL LEAVE, Subsection 955.21, be amended and moved to Section 700, SPECIAL COMPENSATION PROVISIONS, as Subsection 712, to read as follows: 712 Involuntary Termination Lump -Sum Payments for Employees in Executive Pay Plan and Managerial Group Pay Plan The City Manager may authorize lump sum payments for involuntary termination, including requested resignations, within the Executive Pay Plan and Managerial Group Pay Plan managerial group in amounts not to exceed the equivalent of six (6) months of salary for the applicable employee. SECTION 14: If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
