AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A
USE PRIVILEGE AGREEMENT WITH KOCH PETROLEUM GROUP, INC., TO
CONSTRUCT, INSTALL, AND MAINTAIN 80 LINEAR FEET (L.F.) OF
UNDERGROUND 6 -INCH STEEL CASING CONTAINING PERMANENT FIBER
OPTIC CABLES ACROSS THE UP RIVER ROAD RIGHT-OF-WAY LOCATED
APPROXIMATELY 1,100 FEET WEST OF THE CLARKWOOD RIGHT OF WAY;
ESTABLISHING A FEE OF $230; AND DECLARING AN EMERGENCY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager, or his designee, is hereby authorized to execute a Use
Privilege Agreement with Koch Petroleum Group, Inc., to construct, install, and maintain 80 linear
feet (1.f.) of underground 6 -inch steel casing containing permanent fiber optic cables across the Up
River Road right-of-way located approximately 1,100 feet west of the Clarkwood right-of-way,
subject to Owner complying with the following specified conditions as part of the Use Privilege
Agreement:
1) That Owner pay a Use Privilege Agreement one time fee of $230 for the right to
construct, install, and maintain 80 linear feet (11) of underground 6 -inch steel casing
containing permanent fiber optic cables across the Up River Road right-of-way
located approximately 1,100 feet west of the Clarkwobd right-of-way;
SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, do find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this or Jnance i passed and shall take effect upon first reading as an
emergency measure this the 3r day of u , 1999.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
