CLOSING AND ABANDONING A 6,577 -SQUARE FOOT UTILITY
EASEMENT OUT OF THE J. B. HUNTER 10 ACRE TRACT, RECORDED
IN VOLUME 9, PAGE 255, OF THE MAP RECORDS OF NUECES
COUNTY, TEXAS; SUBJECT TO COMPLIANCE WITH THE SPECIFIED
CONDITIONS AND THE OWNER, POWER EQUIPMENT
INTERNATIONAL, INC., REPLATTING THE PROPERTY WITHIN 180
DAYS AT OWNERS EXPENSE; AND DECLARING AN EMERGENCY.
WHEREAS, there is a 6,577 -square foot utility easement out of the J. B. Hunter 10 Acre
Tract, recorded in Volume 9, Page 255, of the Map Records of Nueces County, Texas, and that the
Owner, Power Equipment International, Inc. ("Owner"), wishes to have closed and abandoned.
WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus
Christi to close and abandon said utility easements for public use, subject to the provisions listed
below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the 6,577 -square foot utility easement out of the J. B. Hunter 10 Acre
Tract, recorded in Volume 9, page 255, of the Map Records ofNueces County, Texas, are closed and
abandoned for public use, subject to Owner complying with the following specified conditions as
part of closure:
1) That the Owner pay the fair market value of $850.00 for the 6,577 -square foot
utility easement being closed and abandoned.
2) That the Owner must replat the property within 180 days at its expense. The City
Engineer may extend the time limit for an additional 180 days if extenuating
circumstances outside of the Owner's control necessitate an extension.
SECTION 2. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this or finance 5s, passed and shall take effect upon first reading as an

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
