AMENDING ORDINANCE NO. 023617 RECANVASSING THE RETURNS
AND DECLARING THE RESULTS OF THE RECOUNT FOR DISTRICT
THREE HELD ON APRIL 23, 1999, IN THE CITY OF CORPUS CHRISTI;
AND DECLARING AN EMERGENCY.
WHEREAS, Jesse Noyola, Council Candidate District Three of the City of Corpus Christi
requested a Recount of the Runoff Election held on April 17, 1999 for the election of Council
Member District Three;
WHEREAS, notice of said Recount was given as required by law;
WHEREAS, said Recount was duly held on the 23rd day of April, 1999, in conformity with
the election laws of the State of Texas, and the results of said Recount have been certified and
returned by the Recount Committee; and
WHEREAS, this Council has today recanvassed the returns of said Recount; and
WHEREAS, the Council finds that the said Recount was in all respects lawfully held and that
the Recount Committee's tally and certification of results to the Council are correct:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. The tally of the Recount held on the 23rd day of April, 1999 for Council
Member District Three, be made and certified, a copy of which is attached hereto as Attachment A
and made a part hereof, and the same is hereby adopted as the official tabulation of the votes cast
in District Three, for each candidate in each precinct and in sum, and that said tabulation be filed and
recorded in the official records of the City of Corpus Christi as the official recanvass of said election.
SECTION 2. The results of such recanvass are declared to be:

SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or
provision of this ordinance shall be held invalid or unconstitutional by final judgement of a court of
competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase,

work, or provision of this ordinance, for it is the definite intent of this City Council that every
section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and
effect for its purpose.
SECTION 4. The necessity of making an official recanvass of votes and declaring the results
thereof immediately in order to meet the requirements of State Law and the City Charter creates a
public emergency requiring the suspension of the Charter rule that no ordinance shall be passed
finally on the date of its introduction but that such ordinance shall be read at two regular meetings
of the City Council, and the Mayor having declared that such emergency exists, having requested
the suspension of the Charter rule that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the clay of April, 1999.

For the reasons set forth in the emergency clause of the foregoing ordinance, an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings; I/We, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
