HomeMy WebLinkAbout023642 RES - 05/18/1999RESOLUTION CONSENTING TO THE INCLUSION OF THE CITY OF CORPUS CHRISTI IN THE CERTIFICATE OF CONVENIENCE AND NECESSITY APPLICATION OF CORPUS CHRISTI POWER & LIGHT COMPANY, L. C. WHEREAS, Senate Bill 7 is pending in the current Texas Legislature; and WHEREAS, Corpus Christi Power and Light Company, L. C., has requested to include the City of Corpus Christi in its existing application to the Public Utility Commission of Texas for a Certificate of Convenience and Necessity (CCN application); and WHEREAS, the City supports the issuance of CCN applications to responsible and financially secure companies which have the ability to provide electricity at reasonable and competitive rates, the ability to service customers on a continuous and reliable basis, and the desire to serve all classes of customers, including residential; and WHEREAS, the City of Corpus Christi is an intervenor in PUC Docket No. 19950 wherein Corpus Christi Power and Light Company, L.C.'s application is being reviewed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. The facts and opinions in the preamble are true and correct. SECTION 2. Without agreeing to the merits or legality of the CCN application, the City consents to the inclusion of the City of Corpus Christi in the CCN application of Corpus Christi Power and Light Company, L. C. The City reserves the right to take positions in PUC Docket No. 19950 that may be adverse to the interests of Corpus Christi Power and Light Company, L.C. SECTION 3. Without suggesting that service from Central Power and Light Company is inadequate, the City requests the PUC to carefully review the application of Corpus Christi Power and Light Company, L.C., and grant a CCN if the PUC determines that the application is lawful and meritorious and concludes that Corpus Christi Power and Light Company, L. C., has the financial capital and ability to provide electricity at reasonable and competitive rates and the ability to provide continuous and reliable service to all classes of customers including residential customers in Corpus Christi. Furthermore, the City requests the PUC to allow the infrastructure and financial stability of the existing electrical provider, Central Power and Light Company, not to be materially affected. SECTION 4. This resolution does not give Corpus Christi Power and Light Company, L. C., a franchise or a permit to use the City's rights-of-way, streets, or alleys. C., shall not operate in the City without first obtaining a written franchise agreement and have its capital, infrastructure, services, and rates reviewed by the City. SECTION 5. The rights and obligations of Corpus Christi Power and Light Company, L.C., under this resolution may not be assigned without the consent of the City. SECTION 6.
