HomeMy WebLinkAbout023678 ORD - 06/22/1999AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, RELATING TO THE STORM WATER MANAGEMENT ADVISORY COMMITTEE; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Division 21 of Chapter 2, Article IV, Code of Ordinances, is revised to read as follows: "DIVISION 21. STORM WATER MANAGEMENT ADVISORY COMMITTEE "Sec. 2-231. Composition, organization, and duties. "(a) Composition. "(1) There is a Storm -water Water Management Advisory Committee, which consists of eleven (11) members, representatives of the various community interests. "(2) The advisory committee is appointed by the Mayor, with the approval of the Council. for two year terms of office. Any vacancy shall be filled for the unexpired term. All committee members shall serve without compensation. "(b) Organization. "(1) The advisory committee shall adopt its own rules of procedures. "(2) At the first meeting after creation of the committee, a majority of the whole committee shall elect a chairperson and vice -chairperson to serve during the first term. Thereafter, a committee chairperson and vice -chairperson shall be elected by a majority of the whole committee to serve one-year terms expiring each June 30th. The election of the chairperson and vice -chairperson shall be held each year at the first regular meeting after appointments to fill expired terms. "(3) The advisory committee shall meet not less than six times per year ore-tken with the support and cooperation of the City Manager or his designees. "(c) Duties. The advisory committee shall: "(1) Develop a thorough understanding of the ecology of the receiving waters surrounding the City of Corpus Christi, the composition of the runoff and discharge, the methods for altering the composition of such runoff and discharge, and the relative costs and benefits of City and its Citizens utilizing these various methods to alter the R93417A1.DOC 023678 2 composition of the runoff and discharge, and the requirements of the Clean Water Act and the City's NPDES or TPDES Permit for the discharge of -Storm storm water. "(2) Monitor compliance with and enforcement of the City's current ordinances relating to runoff and discharge of storm water and the elimination of pollutants therefrom. "(3) Advise the Mayor and Council on the appropriateness of the City's current ordinances relating to runoff and discharge of storm water and the elimination of pollutants therefrom. "(4) From time to time suggest changes, expansions, and deletions to those ordinances. "(5) Advise the Mayor and Council on matters relating to the enforcement, modification, and renewal of City of Corpus Christi's NPDES or TPDES Permit for the discharge of storm water. "(6) Advise the Mayor and Council on these issues and activities within a strategy of compliance at minimum feasible cost, that is to assure that the steps taken by the city in the above matters minimize the expenditure of funds by the City and its Citizens, and impose the least possible burden on the conduct of their business, while complying with the Clean Water Act. "(71 Advise the Mayor and Council on the establishment of a municipal drainage utility; the annronriate rate structure for a drainage utility. including appropriate rate classes and the rates charged to each class: and operation of the drainage utility once the utility is established. "Secs. 2-232 — 2-239. Reserved." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
