AMEND ORDINANCE 8127, AS AMENDED, SUBSECTIONS 951.1(a) AND (b), 951.4(a) AND (b), 951.9 (a) AND (b), 952.1, 952.9, AND 952.11 TO BIWEEKLY INSTEAD OF MONTHLY AS THE BASIS FOR LEAVE ACCRUAL AND ADMINISTRATION OF OTHER LEAVE PROVISIONS. AMEND ORDINANCE 8127, AS AMENDED, SECTION 900, TO ADD FRIDAY AFTER THANKSGIVING AS "FLOATING HOLIDAY." AMEND ORDINANCE 8127, AS AMENDED, BY ADDING A NEW SUBSECTION 713 TO PROVIDE FOR CERTIFICATION PAY FOR AVIATION PUBLIC SAFETY OFFICERS; AMEND ORDINANCE 8127, AS AMENDED, TO CLARIFY LANGUAGE ON COMPENSATION UPON INITIAL EMPLOYMENT IN SECTION 551.1. AND PROVIDE FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance 3658, as amended, Section 250, Classification Plan for All Positions in the Classified Service Subsection 251 through 257, be amended by amending Sections 251, 252, 253, 254, 255, 256, and 257 to read as shown in Exhibit A. 023704 Page 2 of 13 SECTION 2. That Ordinance 8127, as amended, Section 510, Managerial Grout) Pay Plan Effective January 18. 1999, be amended by adopting the revised Managerial Group Pav Plan FY 1999- 2000. Effective August 2. 1999, attached hereto as Exhibit B, that includes housekeeping revisions for FY 1999-2000 with no changes to the salary ranges. SECTION 3. That Ordinance 8127, as amended, Section 520, Executive Pay Plan Effective January 18. 1999, be amended by adopting the revised Executive Pay Plan FY 1999-2000. Effective August 2. 1999, attached hereto as Exhibit C, that includes housekeeping revisions for FY 1999-2000 with no changes to the salary ranges. SECTION 4. That Ordinance 8127, as amended, Section 500. Definition and Adoption of the Classification Plan, Subsection 501, Salary Schedules, be amended by deleting Salary Schedule A (Grades 8 through 23) and Salary Schedule B (Grades 24 - 43) effective December 7, 1998, and consolidating them into a one new Salary Schedule for Classified Positions (Grades 8 through 43), effective August 2, 1999, with no changes to the salary ranges, attached hereto as Exhibit D. SECTION 5. That Ordinance 8127, as amended, Section 500. Definition and Adoption of the Classification Plan, Subsection 508, Application of the Comnensation Plan to Positions in the Classified Service be amended to read as follows: 508 The grades assigned to the Salary Schedule for the Classified Service. refer to the grades established for each class of positions in the Classified Service by the Civil Service Board, as defined in Section 103, and included in the Classification Plan as adopted and amended from time to time by the Board. Each employee shall be paid within the range for the grade of his/her position subject to the provisions of this Ordinance on the administration of the Compensation Plan. SECTION 6. That Ordinance 3658, as amended, Section 100. Definition and Adoption of the Classification Plan, Subsection 103, Adoption of the Classification Plan, be amended to read as follows: 103 The classes of positions, as set forth in Section 250 of this Article and the specification for the respective classes, are hereby adopted and shall constitute the Classification Plan on the basis of which all positions in the Classified Service shall be Classified. Classified positions and incumbents thereof who have completed the designated probationary period and any extensions as provided in Article IQ. Section 3. of the Civil Service Board Rules and Regulations shall be subject to Civil Service in accordance with state law, the City Charter, and ordinances. Exemptions from the Classified Service include: (a) all positions included in the "Executive Pay n Page 3 of 13 Plan" under Section 520 of the Compensation Plan Ordinance 8127, as amended; (b) all positions included in the "Managerial Group Pay Plan" under Section 510 of the Compensation Plan Ordinance 8127, as amended; (c) each position, regardless of class title or Grade, filled by an employee who functions as the principal secretary to any of the following positions: City Manager, Deputy City Manager, Assistant City Manager, Municipal Court Judge, Department Director, Assistant Department Director, City Secretary, City Attorney, Assistant City Attorney; (d) all members of the Fire and Police Collective Bargaining Units; and (e) temporary employees as defined in section 653. Except members of the Fire and Police collective bargaining units, exempt officers and employees serve at will, at the pleasure of the City Manager, or designee, or at the pleasure of the City Council if appointed by the City Council, and shall have and continue such at will status notwithstanding any other provision of this Classification Plan, any other City Ordinance, or any Rule or Regulation of the City or any of its agencies. SECTION 7. That Ordinance 3658, as amended, Section 150, Application and Interpretation of Classification Plan, Subsection 151.2, be amended to read as follows: 151.2 Each employee shall be notified of the allocation of his/her position, and each employee who has satisfactorily served in a classified position and completed the applicable probationary period, and any extensions as provided in Article 111, Section 3, of the Civil Service Board Rules and Regulations, is hereby given civil service status in such position provided that in the Police and Fire service no promotions in rank shall be achieved except in accordance with -the with collective bargaining agreements and/or Chapter 143 of the Texas Local Governmental Code. SECTION 8. That Ordinance 8127, as amended, Section 550, Administration of the Compensation Plan, be deleted and replaced to read as follows: 550 (g) The City Manager is instructed to establish fair and equitable Compensation & Classification Plan Administrative Procedures consistent with the Fair Labor Standards Act of 1938 (FLSA), as amended. Procedures shall not apply to Police and Fire Personnel who are covered under collective bargaining contracts. (b) An employee exempted from overtime eligibility. under the Executive, Professional. or Administrative exemption of the Fair Labor Standards Act of 1938 (FLSA). mav be suspended for disciplinary reasons without pay in weekly increments without affecting the employee's exempt status unless the suspension is assessed for an infraction of safety rules of major significance. When discipline is assessed for infraction of safety rules of maior significance. the suspension mav be assessed for less than a week without affecting the employee's exempt status under FLSA. Page 4of13 SECTION 9. That Ordinance 8127, as amended, Section 552, Advancement of Salary Within a Salary Schedule, Subsections 552.0, 552.1, 552.2, and Section 553, Recommendations for Salary Advancement Within Grade, be amended to read as follows: 552.1 Effective August 2. 1999. salary advancement in each salary schedule will be subiect to the terms and provisions of the City's official Policy entitled Performance Evaluation Plan. The Policy shall apply to all City employees except Police and Fire personnel who are covered by collectiv bargaining agreements and have their own evaluation plans. (a) Salary advancement within a grade is aligned to the City's core values and employee competencies as incorporated into the Performance Evaluation Plan Policy as promulgated by the City Manager. The City Manager will consider the economic indicators for each fiscal year and will incorporate funding for the Performance Evaluation Plan in the City's budget as a cost of doing business. subject to approval by the City Council in the adoption of the budget for the new fiscal year. (b) After consideration of the economic indicators for the next fiscal year. the City Manager may recommend to the City Council. as Dart of the budget process each fiscal vear. a cost -of -living adjustment to the minimum and maximum of the salary ranges. and to the base pav of emplovees paid in those ranges. to ensure that the City's Compensation Plan and employee compensation remain sufficiently competitive to attract and retain quality productive emplovees, fc) The Department Head shall recommend in writing to the City Manager. or designee an eligible employee's advancement within his/her salary range in that department based on performance in compliance with Section 552 and the Performance Evaluation Plan Policy. 552.2 No Department Head shall hire, promote. or make a recommendation. or participate in any deliberation or voting upon any change in status or compensation, of anv person related to such department head within the second degree bv affinity or the third degree by consanguinity. fa) Second Degree bv Affinity includes: Spouse. Spouse's in -Laws. Spouse's Grandfather. Grandmother. Grandson. Granddaughter, Spouse's Brother, Spouse's Sister. Brother's Spouse. and/or Sister's Spouse. (b) Third Degree by Consanguinity includes: Father. Mother. Son. Daughter, Grandfather. Grandmother. Granddaughter. Grandson. Sister. Brother. Aunt, Uncle. Niece. Nephew. Great Grandson. Great Granddaughter. Great Grandmother. and Great Grandfather. If an employee is related to the Department Head within the second degree by affinity or the third degree by consanguinity. decisions affecting the employee's status or compensation will be made by the City Manager. or designee. 552.0 Auguet-14999. . Page 5 of 13 SECTION 10. That Ordinance 8127, as amended, Section 551.4, Starting Rate in New Position, be amended to read as follows: 551.4 (a) Whenever an employee is assigned to duty in a position of a different s class code not previously held by him and such change is not in the nature of the promotion (e.g. such as a voluntary or involuntary demotion. transfer to a position with the same pav grade. but a different job class code within the employee's department or another department), he the employee shall receive the entrance rate in the salary schedule established for the class or such other rate within the applicable salary schedule as he/she may be entitled to by reason of crediting lig in his the employee in the new position with such prior service that in found-te Page 6of13 meets the following conditions: the character and nature of the duties of the position to which the employee was assigned are similar to those of the new position; the service in the former position provided experience which is valuable to the performance of the duties eft in the new position. (b) No salary advancement within the pay range is authorized when an employee laterally transfers within the employee's department. or to another department. to a position with the exact same lob class code and rade as held at the time of transfer (e.Q Laborer. Grade 8. to Laborer. Grade 8 position). Lateral transfers must meet the reauirements of the Civil Service Board Rules and Regulations. SECTION 11. That Ordinance 8127, as amended, in the title of Section 551.7, be amended from Classification/Title Changes Within the Managerial Group to read Classification/Title Changes Within the Executive Pay Plan and the Managerial Group Pay Plan. SECTION 12. That Ordinance 8127, as amended, Sections 951.12(a), Payment of Sick Leave Upon Termination, and 951.12(b), Payment of Sick Leave upon Termination for Aimort Public Safety Officers. under Leave Plan I; and Sections 952.5, Payment of Vacation Leave upon Termination, and 952.13, Payment of Sick Leave upon Termination, under Leave Plan 11 be amended to read as follows: 951.12 (a) Payment of Sick Leave Upon Termination. A Plan I employee. with the exception of Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. who terminates due to any of the following conditions. will be eligible for payment of up to 720 hours of accumulated sick leave credit that can be cashed in for the equivalent of up to 360 hours of pay at the rate of the employee's last monthly salary or hourly rate: (1) when eligible for retirement under requirements of the Texas Municipal Retirement System Act (TMRS); (2) due to disability or service retirement: (3) is age 60 on completion of a minimum of ten years continuous service: or (4) upon death. in such case payment will be made to the employee's designated beneficiary. - - - --- .. Page 7 of 13 951.12 (b) Payment of Sick Leave Upon Termination for Airport Public Safety Officers -4€ 951.12 (b) Payment of Sick Leave Upon Termination. Plan I Airport Public Safety Officers, who work shifts of 24 hours on and 48 hours off, who terminate due to any of the following conditions, will be eligible for payment of up to 1.080 hours of accumulated sick leave credit that can be cashed in for the - • uivalent of up to 540 hours of nay at the rate of the employee's last monthly salary or hourly rate: (1) when eligible for retirement under requirements of the Texas Municipal Retirement System Act (TMRS): (2) due to disability or service retirement: (3) age 60 upon completion of a minimum of ten years continuous service: or (4) upon death, in such case payment will be made to the employee's designated beneficiary. 952.5 Payment of Vacation Leave Upon Terminatio srJL_1 952..5 Payment of Vacation Leave Upon Termination. Plan II Employees. including Police and Fire personnel covered by collective bargaining agreements. who have been employed by the City for a minimum of 12 months. will receive up to 240 working hours of vacation paid to the employee upon termination. except that all accrued vacation shall be paid to Plan II employees or their beneficiaries when any of the following provisions apply: (1) employee is eligible for retirement under requirements of the Texas Municipal Retirement System Act (TMRS): (2) employee takes a service or disability retirement in accordance with TMRS and/or Social Security Regulations: (3) employee is age 60 upon completion of a minimum of ten years continuous service with the City: or (4) upon employee's death, in such case payment will be made to the employee's designated beneficiary. 952.13 Payment of Sick Leave Upon Termination. SECTION 13: That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan I, Subsection 951.1(a),Vacation Leave Accrual, and (b), Vacation Leave Accrual for Airport Public Safety Officers, be amended to read as follows: 951.1 (a) Vacation Leave Accrual. Plan I Employees, except for Airport Public Safety Officers who work a shift of 24 hours on and 48 hours oft earn vacation leave on the basis of 26 biweekly pay periods and 40 -base hours per week, or if base hours are less than 40 hours per week, monthly -based on Years of Service Less than 6 years of service Beginning the 6th year Beginning the 16th Beginning the 31n year on a pro -rated basis. Accrual rates are as follows: Monthly 7.333333 8.666667 1; 44 Annual Rate/Hours per Year 88 104 144 168 951.1 (b) Vacation Leave Accrual for Airport Public Safety Officers. Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off ear vacation leave on the basis of 26 biweekly pav periods and 12 hour shifts with the following accrual rates (monthly-seertrel Years of Service Less than 6 years of service Beginning the 6th year Beginning the 16th year Beginning the 31st year Page 9of13 Monthly —Hears Pe -Year Accrual Rate/Hours per Year 44 132 d3 156 48- 216 24- 252 SECTION 14: That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan 1, Subsection 951.4 (a), Accumulation and Carryover of Vacation Leave. and (b), Accumulation and Carryover of Vacation Leave for Airport Public Safety Officers. to read as follows: 951.4 (a) Accumulation and Carryover of Vacation Leave. Vacation leave credit may be accumulated by Plan I Employees, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off, to a maximum of 240 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 240 hours as of the last pay period day -of the-ffienth_of the calendar year will be deleted if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance, work requirements, or for other purposes deemed beneficial to the City Service. 951.4 (b) Accumulation and Carryover of Vacation Leave for Airport Public Safety Officers. Vacation leave credit may be accumulated by Airport Public Safety Officers, who work shifts of 24 hours on and 48 hours off, up to a maximum of 360 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 360 hours as of the last pay period day -of -the the month of the calendar year will be forfeited if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance, work requirements, or for other purposes deemed beneficial to the City Service. SECTION 15: That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 951.0, Leave Plan I, Subsection 951.9 (a) Sick Leave Accrual and Accumulation and (b), Sick Leave Accrual and Accumulation for Airport Public safetv Officers, be amended to read as follows: 951.9 (a) Sick Leave Accrual and Accumulation. All eligible Plan I Employees, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off, eam and are allowed sick leave at the rate of 96 hours for each year of continuous service, accrued on the basis of 26 biweekly pay periods monthly. Sick leave may be accumulated to a maximum of 960 hours. Page 10 of 13 951.9(b) Sick Leave Accrual and Accumulation for Airport Public Safety Officers. All eligible Airport Public Safety Officers who work a shift of 24 hours on and 48 hours og earn and are allowed sick leave at the rate of 144 hours for each year of continuous service, accrued on the basis of 26 bi- weekly vav periods monthly. Sick leave may be accumulated to a maximum of 1,440 hours. SECTION 16: That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 952.0, Leave Plan 11. Subsections 952.1, Vacation Leave Accrual, to read as follows: 952.1 Effective August 1, 1982, all Plan II Employees who are eligible to accrue vacation leave shall eam such leave on the basis of 26 biweekly pay periods and 40 base hours per week, or if less than 40 hours per week, en -the -basis -of on a pro -rated basis. Because vacation leave is a benefit for employees to provide paid time away from work for purposes of relaxation, personal development, and enjoyment of life, and because Plan II Employees may accumulate vacation leave without limit, all Plan II employees are required to take a minimum of forty (40) working hours of accrued vacation leave before the lest -day end of the last pay period of the calendar year as vacation or forfeit that portion of vacation leave, up to 40 hours, which is not taken. Page 11 of 13 SECTION 18: That Ordinance 8127, as amended, Section 950, Leaves of Absence, Subsection 952.0, Leave Plan II, Subsections 952.11, Sick Leave, be replaced by a new Subsection 952.11 to read as follows: 952.11 Sick Leave. Plan II Employees shall accrue and be allowed sick leave with pay at the rate of 96 working hours for each year of continuous service to be accrued monthly on the basis of 26 hi -weekly nay periods. SECTION 19. That Ordinance 8127, as amended, Section 900, Holidays, Subsection 900.1, be replaced by a new Subsection 900.1 to read as follows: 900.1 The following days, or parts of days, are hereby declared holidays for all eligible City officers and employees: The first day of January (New Year's Day) The last Monday of May (Memorial Day) The fourth day of July (Independence Day) The first Monday of September (Labor Day) The fourth Thursday of November (Thanksgiving Day) The Friday immediately following the fourth Thursday of November (Dav following Thanksgiving Davi The twenty-fifth day of December (Christmas Day); SECTION 20. That Ordinance 8127, as amended, Section 700, Special Compensation Provisions be amended by adding a new Subsection 713. Certification Pay for Aviation Public Safety Officers, to read as follows: 713 In addition to base pay, an Aviation Public Safety Officer, who has successfully passed his/her probationary period as required by Civil Service Board Rules and Regulations, and who has been certified by the appropriate state and/or federal agency, shall receive monthly certification pay according to the level of certification as follows: Page 12of13 Intermediate Law Enforcement and Fire $20 Advanced Law Enforcement and Fire $25 Master Law Enforcement, Fire, or ARFF $30 Emergency Medical Technician (EMT) $35 Paramedic $75 Basic Instructor $35 Intermediate Advanced, or Master Instructor one or more $75 SECTION 21. That Ordinance 8127, as amended, Section550, Administration of the Compensation Plan, Subsection 551.1, Starting Rate on Initial Employment, be amended to read as follows: 551.1 Upon initial employment, the City Manager. or designee. may approve may approve initial compensation for positions in Grade 8 through 17 at any rate between the minimum and midnoint of the range in the appropriate salary grade when experience. skill. training, or labor market conditions iustifv the action. Initial employment compensation that exceeds the midpoint of the salary range will require approval of the City Manager. or designee. The City Manager or designee. may approve initial compensation in salary grades 18 through 43 at any rate between the minimum and midpoint of the salary range in the appropriate salary grade when exceptional experience. training or labor market conditions justify the action.. Initial employment compensation in salary grades 18 through 43 that exceeds the midnoint will require approval of the City Manager, or designee. The City Manager. or designee. may initially compensate an employee in the Executive Pay Plan and the Managerial Group Pay Plan at any salary amount between minimum and maximum of the annual salary range for the position. Further salary advancement will be based on performance and in compliance with Section 552, Advancement of Salary within the Salary Schedule. • • Page 12of12 SECTION 22: If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
