HomeMy WebLinkAbout023715 ORD - 07/27/1999AN ORDINANCE CLOSING, BUT NOT ABANDONING THE JOHN SARTAIN STREET MEDIAN CROSSOVER STREET RIGHT-OF-WAY BETWEEN THE NORTHBOUND AND SOUTHBOUND LEGS OF SHORELINE BOULEVARD AS RECORDED BY PLAT OF BLOCK 1, SOUTH WATER BEACH, SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS, AND DECLARING AN EMERGENCY. WHEREAS, the proposed expansion of the Art Center of Corpus Christi and parking lot necessitates the closure, but not abandonment of the existing John Sartain Street median crossover street right-of-way; and WHEREAS, the John Sartain Street median crossover street right-of-way between the northbound and southbound legs of Shoreline Boulevard as recorded by plat of Block 1, South Water Beach, is subject to closure, but not abandonment, at the request of the City of Corpus Christi ("Owner"), subject to compliance with the specified conditions and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to close said street right-of-way for public use, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE.CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the John Sartain Street median crossover street right-of-way between the northbound and southbound legs of Shoreline Boulevard as recorded by plat of Block 1, South Water Beach, is closed, but not abandoned, subject to the following specified conditions as part of the closure: 1. That payment of fair market value for the street closure be waived because the City is initiating the closure but not the abandonment, of the street right-of-way. 2. That the City, as Owner, dedicate the entire square foot portion of the closed right-of- way as a utility easement. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this rdinance is passed and shall take effect upon first reading as an emergency measure this the y of�� , 1999.
