HomeMy WebLinkAbout023720 ORD - 08/22/1999ORDER PROHIBITING PRICE GOUGING WHEREAS, a State of Disaster has been declared because the approach of Hurricane Bret poses an imminent threat of widespread or severe damage, injury, or loss of life or property; and WHEREAS, price gouging inhibits and prevents citizens from taking measures necessary to protect themselves from the imminent threat posed by Hurricane Bret. It is, therefore, ORDERED, that the following are prohibited during the State of Disaster: 1) To take advantage of the disaster by: A) Selling or leasing fuel, food, medicine, or another necessity at an exorbitant or excessive price; or B) Demanding an exorbitant or excessive price in connection with the sale or lease of fuel, food, medicine, or another necessity; or 2) To commit an unconscionable act or practice in connection with the sale of fuel, food, medicine, or another necessity. In this Order, whether an item is a "necessity" shall be determined under the conditions existing during the State of Disaster, and "unconscionable action or course of action" means an act or practice which, to a person's detriment: A) takes advantage of the lack of knowledge, ability, experience, or capacity of a person to a grossly unfair degree; or B) results in a gross disparity between the value received and consideration paid, in a transaction involving transfer of consideration.
