AN ORDINANCE
AMENDING ORDINANCE 8127, SUBSECTION 952.13,
PAYMENT OF SICK LEAVE UPON TERMINATION, TO
CORRECT CLERICAL ERROR IN ORDINANCE 023704;
PROVIDING FOR SEVERANCE; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1.
read as follows:
That Ordinance 8127, as amended, Section 952.13 be amended to
952.13 Payment of Sick Leave Upon Termination. Plan 11 Employees who terminate
due to any of the following conditions will be paid up to 720 working hours of earned
and accrued sick leave, if any, when any of the following provisions apply: (1) employee
is eligible for retirement under requirements of the Texas Municipal Retirement System
Act (TMRS): (2) employee takes a service or disability retirement in accordance with
TMRS and/or Social Security Regulations; (3) employee is age 60, or over, upon
completion of a minimum of ten years continuous service with the City: or (4) upon
employee's death. with payment made to the employee's designated beneficiary. Payment
of such earned and accrued sick leave, if any, shall be at the rate of the employee's last
monthly salary or hourly rate for an equivalent period.

SECTION 2: If, for any reason, any section, paragraph, subdivision, clause, phrase,
word or provision of this Ordinance shall be held invalid or unconstitutional by final
judgement of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision hereof be given full force and effect for its purpose.
SECTION 3: That upon written request of the Mayor or five Council Members, copy
attached, to find and declare an emergency due to the need for the efficient and effective
administration of City affairs, such finding of an emergency is made and declared
requiring suspension of the Charter Rule as to consideration and voting upon ordinances
at two regular meetings so that this Ordinance is passed and shall take effect upon first
reading as an emergency measure.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring
suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings: I/we,
therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
