HomeMy WebLinkAbout023765 ORD - 09/14/1999AN ORDINANCE GRANTING A STANDARD SCREENING FENCE EXCEPTION TO MCDONALD'S CORPORATION ALONG THE SOUTH AND EAST PROPERTY LINES OF 1.071 ACRES OF LOT 16, SECTION 28, FLOUR BLUFF AND ENCINAL FARM AND GARDENS TRACT WHEREAS, the McDonald's Corporation has requested an exception from the standard screening fence requirement in Section 27-3.01.06 of the Zoning Ordinance on 1.071 acres of Lot 16, Section 28, Flour Bluff and Encinal Farm and Gardens Tract, located on the south side of South Padre Island Drive and on the east side of Rodd Field Road; and WHEREAS, the City Council finds that there have been no building permits issued upon any lot or lots adjacent to the property of the applicant for construction of any residential structures; and WHEREAS, the City Council finds that no residential structures exist on any lot or lots adjacent to the property of the applicant; and WHEREAS, the City Council finds that the waiver of screening fence requirement will not affect adversely the uses of adjacent and neighboring property permitted by this Ordinance; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The installation of the standard screening fence, required by Section 27-3.01.06 of the Zoning Ordinance, along the south and east property lines of the 1.071 acres of Lot 16, Section 28, Flour Bluff and Encinal Farm and Gardens Tract, owned by the McDonald's Corporation, which is located on the south side of South Padre Island Drive and on the east side of Rodd Field Road, is not required until such time a residential building permit is issued on the adjacent properties. SECTION 2. The area between the west property line and the boat barns must be maintained free of debris and weeds/grass over four inches in height.
