HomeMy WebLinkAbout023776 ORD - 09/28/1999AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A USE PRIVILEGE AGREEMENT WITH SILVERIO VALENCIA, JR., TO INSTALL, OPERATE, MAINTAIN, AND REMOVE A 2-1/2" FORCE MAIN IN THE GREENWOOD DRIVE STREET RIGHT- OF-WAY, APPROXIMATELY 30 -FEET IN LENGTH TO TIE INTO AN EXISTING SANITARY SEWER MANHOLE, IN CONSIDERATION OF PAYMENT OF $380.00, AND OTHER SPECIFIED CONDITIONS; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is hereby authorized to execute a Use Privilege Agreement with Silverio Valencia, Jr., to install, operate, maintain, and remove a 2- 1/2" diamater PVC force (wastewater) main in the Greenwood Drive Street right-of-way, approximately 30 -feet in length, and tie into an existing sanitary sewer manhole, and subject to the following specified conditions: 1. That Silverio Valencia, Jr. pay a Use Privilege Agreement one-time fee of $380.00 for the right to install, operate, maintain, and remove a 2-1/2" diameter PVC force (wastewater) main in the Greenwood Drive Street right-of-way, approximately 30 - feet in length. 2. The force main must have a minimum cover of 3 -feet in depth from the elevation of natural ground along the property line and below the flowline of existing City drainage ditch. 3. Owner is to provide a private easement by separate instrument within any and all private properties for the force main. 4. Owner will be solely responsible for the operation, maintenance, and removal of the force main. An Engineering Permit will be required for any future repairs of the force main within City right-of-way. SECTION 2. That upon written request of the. Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances H:\LEG-DIR\SHINDA\JERRY\ORDINANC\076.OR D 023776 at two regular meetings so that this oslinance passed daand �pshall take effect upon first reading as an emergency measure this the a 5 'day of , 461999.
